Default NHR

Hello we are looking at moving over permanently for the next 10 years and im confused as to what we need to apply for. Before we would have applied for the NHR but now what do we apply for to get the same terms. We have property rental company in the UK and so would continue to run that from Lisbon but want to live in Lisbon full time

Not sure from what you've posted here now and in the past as to whether you or any of your family have previously registered as resident in Portugal.

Assuming you are a UK citizen and have no EU citizenship, and you are starting from scratch, what you will need to do in order to become resident in Portugal now is to apply in the first instance for a visa through one of the Portuguese Consulates in the UK. All info, links etc are here under the heading "National Visas"Following that, you'll need to apply within the allotted time to the SEF here in Portugal for the appropriate residence permit.

If you or your spouse have previously registered as resident and remained continuously resident as defined in the law, you will have an easier route to the required residence documentation.

NHR is an entirely separate issue, being solely a tax regime. It is open to all new residents provided they have not been tax resident in Portugal for any of the previous 5 tax years.

Your working / business affairs might not be as completely straightforward as your summary implies. I don't think you can just absent yourself and keep everything else as is - there are matters of tax and social security contributions and how you structure your arrangments to make sure you're complying with both countries' requirements to take into account. I know very little about it other than that it can be a minefield and you may therefore need to take advice from someone experienced in advising on cross-border arrangements between the 2 countries.

Hope this helps point you in the right direction for starters.

So what is the difference between Residency and applying for an NHR now. We have never been residents or lived in Portgual before, also it is harder to get an NHR now?

Residency and NHR are not the same thing, you must obtain residency prior to applying for NHR which is s tax break for 10 years.

You cannot sign up to NHR if you have been a resident of Portugal in the previous 5 years before application.

Or - at least in my own experience - if you have ever been a resident of Portugal before and forgot to cancel your residency at that time.

Well if you don't cancel it then the authorities will assume that you are still resident.

Yes. Even when presented with abundant evidence that one was not resident in the last 20 years

No one said it was fair, you made a mistake by not informing them.

Thems the rules unfortunately...

You are entirely misunderstanding NHR. It is purely and simply the name of a special tax regime. It applies for up to 10 years after you become resident. In itself it doesn't give you residence rights nor does it limit you to 10 years' residence. You need to deal with the residency side of things first and foremost. Once you have that sorted, you may apply for NHR tax treatment, assuming it would be of any benefit to you given your particular circumstances.

Yes, getting permission to reside and the associated documentation is now a good deal more demanding. I refer you to my response to your opening post on this thread on that topic.

Applying for NHR has not suffered any alterations owing to Brexit - its exactly the same process for UK citizens as it is for any other nationality.

Thank you i now understand that. So can you tell me why its more onerous to get residency now, do we need to be living in PT to get this or can we get it done whilst still here in UK
Also so you know anyone who can do this and does it well
