Inherited Villa in Algarve Portugal
Hi All,
First time using this forum Hello, We are about to inherit a share of a villa in Algarve Portugal, 50% of the new owners want to keep their share and the other 50% are not interested and want to sell their share. We love Portugal and want to keep our share but unfortunately we are not in a position to buy the other parties out. Has anyone out there had any experience of this problem, can the other parties force us to sell? Any advise is much appreciated Thank you |

Thank you for the advice, unfortunately it has already split the Family, having all already received many legally worded emails from the other parties involved threatening legal action if we do not agree to sell.

I don't know much about UK law now but as I understand it, your problem might be affected by whether the UK or Portuguese laws were applied & that will depend on how the will was written..................... If a Portuguese style will or no will then the Portuguese inheritance laws will apply & in that case, I think you'll find the other owners can't force you to sell but neither can you force them to pay any maintenance bills etc which is one of the reasons why the country is littered with old houses falling into alarming disrepair.
Probably the best thing to do is consult a Portuguese lawyer to find out exactly where you stand. |

Get legal advice from a professional.
I'm pretty sure that when it goes to court, the judge will order a sale; there is a procedure where an expert is appointed by the court to set a price. You'll all come out better off if you can agree terms yourselves, with your lawyer's help. I don't think there's any use trying to keep the villa when your co-owner[s] wish to sell. |
