Habitation license
 
A habitation license is not required for a house built before 19??
Can anyone fill in the blanks ? I am receiving conflicting answers from estate agents etc.

We have a house built before 1950 and have a habitation license. We bought it in 1997 before it was renovated and our estate agent (who was also a lawyer) got it before we moved in. Because it in a !casa antiga! we paid no rates, then years later a few Euros and now about 50 Euros I think. We are not in any city limits which may make a difference,

1951, it should have an exemption certificate instead.

Just to expand a little bit on the previous answer - although 1951 is a general guide it is a little more nuanced than that depending on your locality, eg

Exemption certificate

Some properties are given an exemption, and do not need a habitation license. This is because the property was built (and has not been altered) prior to the introduction of construction regulations. The relevant date varies from council to council, and whilst you will often hear this type of document referred to as a "pre-1951 certificate" some councils will issue these certificates for properties built at later dates, well into the 1970's.

1951 was the date I had in mind but an estate agent has given me an exception certificate (supplied allegedly from the local Camera) for a property as it was built prior to 1988. !!! Any one reading my posts will realise I am becoming more and more sceptical about estate agents but this may be genuinely correct . Thank you all.

The estate agent works for the seller, not the buyer.

Hire a lawyer to check all paperwork. Whatever the estate agent tells you, check with your lawyer.
And tell the agent that's what you're doing, just to save time.

Why mess about?
Yo and Yo Lawyer who advice do a Promissory Contract (contrato de promessa de compra e venda) which both parties legally bind themselves so he/she/they just put " Habitation license to be available 2 weeks before sale" and stop wasting everyone's time.

Not necessarily true. We have bought four properties here and three times used the estate agent, the fourth time was a direct purchase from the owners.

Some great advice , thank you.
The certificate was genuine but only lasts 5 years and was written June 2016, (detail missed by my lawyer). The camara computer has clear pictures of the property from 2016 which were taken before the renovations. If the renovations didnt need planning permission then a new certificate should be given by return of post .....in theory with an if !!!
