Default Gas Esquentador + Extractor

Does anyone know if I am being given bul**it.
I have a lounge with kitchen as one room. The total area is +35m/2 with 2 large sliding double door/windows.
There is an extractor above the electric hob and 3 mtrs away is the wall mounted esquentador (11ltrs) .
Both pieces of equipment have totally separate flues that both go straight to the outside, 3 mtrs apart and being one storey house in fact both go vertically to the outside.
I have been told that I MUST have an esquentador with a fan (ventilado) and atmospheric is not allowed.
I do not want one with a fan due to fan noise being an all in one lounge/kitchen
I could understand if the flues joined at a Y piece as is often the case, but not fully separate.
Does anyone have any knowledge?

If you don't want fan noise, why have an extractor fan?

My highlighting. Though it could be an extractor without a fan, if such a thing exists.

We have a similar situation in the UK, it's to do with vitiated air. A long time ago I was Corgi registered and when putting in sealed system flues, which draws in fresh air and exhausts used gases through a sealed appliance is o.k. However when a gas appliance that takes air from the room, needs enough air from said room, There is a calculation via m3 footage not m2 footage. If it is deemed not to be big enough then an air brick or bricks need to be installed at low level, that can not be closed to give extra air. It is a safety issue that is taken very seriously as many deaths have happened in the past. You should ask if extra air via another source would be acceptable, rather than a fan.

As above - if you've got an extractor system in the same room as a fire, you might need an airbrick or fan-assist for the fire, as theoretically carbon monoxide can be sucked into the room instead of going up the chimney.

Can you get a 11 ltr esquentador without its in built extractor.? Pretty sure you need the extractor. Would be daft to simply disconnect it as it's mounted at the top of the unit. The esquentador would then overheat and cut out.
The extracter fan noise doesn't last long. When u run a hot tap, run the shower and it isn't noisy.

What happens is the extractor fan can reverse the flue products so pulling them into the room rather than executing via the chimney. In the UK the present procedure is to smoke test the open flue with the extractor fan on full to see if all the products still go up the flue and not back into the room. Have no idea what the regulations in Portugal are though.
