E..U. nonsense
 
I am in Wales for 6 months.I always come every summer for 3. I am having work done on my house but it is raining every day! I am a Portuguese resident. Is there a rule against this?

My second question, there are new rules on entering Europe next year, being a resident I assume that there is no paperwork?

As you are a resident, you are exempt from the new rules when entering Portugal.

You obtained your residency as per the Brexit withdrawal agreement?

You are not a Portuguese citizen?

I am not a citizen but I have a Portuguese residencia card!

My understanding is if you spend more than 183 days in any country you automatically become a tax resident.

Depends on your residency status.

If you are a UK citizen with protected rights under the Brexit Withdrawal Agreement, absences totalling up to 6 months in any year don't affect your right to permanent residence status, which you can apply for after 5 years. If you have already been resident for 5 years and have been issued a permanent resident document, absences of up to 5 years are allowed.

  • The holder of a temporary Residence Permit who intends to be absent from Portugal, during the validity period, for a timeframe exceeding six consecutive months or eight unsequential months has a duty to inform SEF before leaving national territory
  • The holder of a permanent Residence Permit who intends to be absent from Portugal, for a period exceeding twenty four consecutive months or, in a timeframe of three years, be absent thirty unsequential months, has a duty to inform SEF before leaving national territory

We've just had my mother in law here for 2 months. She got residency in mid 2021 (my wife is an immigration lawyer, and it was only way she could visit as a Brazilian at that time because of covid). She stayed 3 months in 2021, left around August 2021 and didn't visit again until this year when she arrived end of June for 2 month visit. So nearly two years out of country. She didn't have any problems at all at immigration re her residency status.
