The photos are only a couple of weeks old....the good one of the pool was taken early April...the comment being made to the taker was that they should be off site on our part of phase 2 Friday 10th April...Just the habitation licence now which was applied for on 18th Feb.

Piperken - just out of interest, what problem did you have with the Gomera complex? (no connection, just curious as we have an apartment there).

There was an issue with planning permission. I waited 18 months and then finally requested my deposit back. Not sure if planning was ever granted. Some companies seem to specialise in selling 'off plan' when in fact they do not even have planning permission. I will not mention any names !!
Still waiting for my refund though !!

Hi there. I purchased an apartment on the Royal Cabanas Beach 2 complex which were originally scheduled for completion this year, however due to planning issues they have still not laid a brick and so the contract has been breached. They have offered alternatives on the Beach 1 complex or Cabanas Golf can anyone give me some help on these 2 complexes. Alternatively I have heard that Portuguese Law states that if the contract is breached the seller should pay back double the deposit. Does anyone know if this is true. Thanks

When buying off plan the contracts can be different in wording to those when you buy already built or land and ruins. the contracts often require a reservation fee, then normally 3 stage payments. I suggest you read the contract you signed (I hope you signed an English translation as well as a Portuguese copy) and take it to your lawyer and seek professional/legal advice. This way you will be acting in the correct manner and your lawyer will write all correspondence to the company. I hope you chose an independent lawyer and not the company lawyer. If you did use the company lawyer, approach them first and advise them that you may/will be seeking legal advice independently. Good Luck.
As for the other two complexes - once bitten twice shy - This you can also asked your lawyer about.

Thumbs up Re: CABANAS GOLF DEVELOPERS DUJA

We too bought on Cabanas Beach 2, over two years ago, and when we over there last summer we saw Cabanas Beach 1 and that Beach 2 was nowhere near started. We transferred to Beach 2 then and had our solicitor (we have one in UK and one in Almancil) draw up all the necessary transfers. Hopefully all the workmen are off site now and a habitation licence should be issued soon. We anticipate being in our apartment in July, fingers crossed! We dealt with Louis directly from the Tavira office and the staff there are very helpful. Good luck, hope whatever you decide works out.

Hi there,

Myself and a work colleague received a rather disturbing letter which needed signing for this morning to our home addresses. Both of us have purchased an apartment on phase 3 Cabanas Golf through 'Haven Overseas' and this letter was sent from Madrid, Spain. From what I could make of the letter I think it stated that a company had gone bankrupt and that we were to seek legal advice.

Has anyone else received such a letter and can anyone explain what it means???

Many thanks,

Carwyn

Your very first action before you do anything else should be to contact your lawyer in Portugal immediately!!!!!
