would my children get a British passport?
 
Hi all just saw this query arise on another thread but didn't want to hijack it and an issue that has filled me with fear slightly - I am British but was born in Dubai although I have a British birth certificate from the British Consulate there. We didn't move back to the UK until I was 11. My mum is British but was born in Hong Kong (although it was a colony back then of course!) and my dad born in good ole' Paisley - lucky for my brother and me it would seem! My husband is Kiwi but now has a British passport through having been here for so long - so that doesn't count I guess!

I looked at the links posted on another thread and typically of the Home Office it made diddly squat sense to me :blink: so does this mean that our children (whenever we have them) don't have an automatic right to a British passport through me because I was born overseas, even though I hold a British birth certificate and have had a passport from birth?

I'm not planning on moving back to the UK but would like to get them sorted with passports etc just in case (you never know what curve balls life will throw at you) - and for their own sakes when they are older and may want to vist and live in the UK blah blah.....

ps - Picked this up from Simonsi's post for the other passport query from the UK Border Agency page - 'You may have had citizenship of the United Kingdom and Colonies by descent from a father who had that citizenship, or because you were registered or naturalised as a citizen of the United Kingdom and Colonies.' - I guess I would qualify for both as I was registered and naturalised?

You're British by descent unless your parents were in UK-recruited Crown Service when you were born. You're not naturalised or registered British.

But you say your husband is British by residence ... go and look at his citizenship document. If it says "Certificate of Naturalisation" then he's British otherwise than by descent and can pass on British citizenship to non-UK born children.

If it says "Certificate of registration" then you're going to need to give more details about exactly what the certificate says.

My husband has a certificate of naturalisation thank goodness!

How bizarre that our children will get British nationality as a result of that - despite his getting his de facto visa and indefinite leave to remain in the UK as a result of our relationship, but our children can't get British citizenship through me :blink: Oh well whatever works I guess!

Thank you so very much for your help it is a relief to know that we won't have to go down the ancestral visa route for our future kids.....:D

Having a British passport will be invaluable for them as they grow older, well worth getting it sorted out now.
