switching Jobs on a work Visa
 

We have a 3 year work permit but OH is working for a company that is going down hill and he wishes to go to another company (doing the same occupation). Has any one done the same....what do we need to do. Our son and his wife has just obtained their residency and will be sponsoring us in three years.

Best bet is to contact NZIS & ask their opinion. If his work visa states in the passport that his job is tied to XXX company doing XXXX occupation, then he may have to re-apply. Best bet is to speak to NZIS as they should be able to let you know all the options.

What NZ4Now said. Look at your blue stickers and see what the wording says. It should state the job title/role and any conditions like a specific employer and possibly a specific location. Also, how long has OH been working for the company he wishes to leave? Is there a condition on the blue sticker saying how long he must work for them and if so, has that obligation been met?

Definitely contact NZIS and discuss what the options are.

Finally, and not trying to put too much of a downer on it, but you should be aware that the sponsorship thing once your son has been resident for three years can take a couple of years to process and approve. At present this cannot be applied for prior to the 3 years being up and cases are looked at in date of application order (like I said, last I heard they were quoting up to 2 years processing time) so you would need something to cover yourselves to stay in NZ legally during that time period. However, the rules can change on these things at any time so it is always worth checking the NZIS website periodically.

Thanks for the reply, the reason he must move to another company is before the one he's working for goes bust. I will get in touch with NZIS and get some information.:thumbup:

He should contact NZIS and state that he will most likely be moving employers.

He will need to apply for a new work permit. NZIS will log that the change will be taking place and will send out the necessary form. There will be a fee of course.

Just to add that this will be a brand new work permit application. It will go through all the same checks as your previous application.
NZIS will want to know that there is no NZ citizen or resident for any new job offered to your husband.

So - if his work is on the Absolute long term shortage list , then no sweat.

If his new job offer is for an accredited employer it should be OK.

If it isn't on either , then the labour market test will be applied and the employer that offers your husband work will need to fill in the Employers Supplementary form and send in evidence that there is no NZ resident/citizen that could take that work.
