Should NZ copy Britain in immigration rules ?
 
With a rather sour nephew being thrown out of the UK after five years I wonder if we should bring the same rules in for Brits wanting to settle in NZ ?
It seems that with all the Bulgarians etc who want to settle in the UK kiwis are no longer needed or wanted.

So,why should we be generous to Brits if we are getting the dirty end of the stick ?

Not sure I understand & it would be very difficult to compare without knowing further details.

What UK visa was he on?

For example, did he apply in his own right to live and permanently reside in the UK by dint of his qualifications & occupation . THose same quals & occupation being needed in the UK as there was/is a shortage ? As per the NZIS skilled migrant category.

Did he invest into the UK as per the investment visas?

I didn't think that Brits did get a special deal if migrating to New Zealand? Don't they have to meet the same visa rules as everyone else - including Bulgarians? :confused:

I have been browsing the NZ High Commission website to see what is available.
It seems very similar to the NZIS from the little I have read TBH.

Until we hear from Tehori as to why his/her nephew was not given leave to remain after 4/5 yrs, it's a bit hard to form an opinion. After all overseas people on temp visas here in NZ can and have found themselves in the exact same situation.

Perhaps his/her issue is with Commonwealth citizens v Europeans ? Bit like the Australia/New Zealand residency thing.

The Bulgarians etc you mention can settle in the UK, are enjoying freedom of movement and work within the EU. Rules the UK voters never got a say on. All non EU residents of the UK are getting the sharp end of the political stick, regardless of their Commonwealth background.

The special deal which I as a UK citizen got from the NZ government was a nearly 2 year process, with endless vetting, form filling, medicals and cost around $10000 by the time professional registration fees were applied (a term of the visas). However this is an attitude I have encountered before in certain parts of the S.I.

So yes to confirm your deep bias, we all walk in for nothing, John Key personally meets us at the Koru lounge, hands us the deeds to a house and section gratis and allows us to take our pick of the local girls and best jobs- where I don't need to pay any tax.

Spot on we even had to stand in front of the NZ Immi appointed doctor and touch our toes as part of the process of restricted entry :sneaky:
I also had to wear an automatic blood pressure monitoring device that took my pressures every hour because I was already taking medication for hypertension, then spend another heap of cash to get a specialists Orthopedic surgeons report on a knee op I had 3 years earlier to say it was OK...generous to Brits...?

:) I would be interested in why the nephew was "kicked" out. Every country has the right to set its own rules and we all have the responsibility to ensure we know them when we choose to move.

The Uk government changed the rules about NZ's/Aussies wanting to stay longer than the standard 2 years. I guess it was an easy target.
I wasnt aware NZ was generous to Brits who wanted to stay longer, never looked into tbh tho.

is doing the rounds at the moment, went over on a spousal visa. My opinion, why when the visa was due to run out, 2011, did she not apply for a visa for herself? Does this mean she has actually been working and living in the UK illegally since then?

She should have done it in 2008. What's more, although I can't blame her, she should never have taken the UKBA at their word at the time, but instead should have done everything in her power to fast-track the application, including getting her MP involved. Unfortunately for her, nine years isn't long enough to fall under Indefinite Leave to Remain on the basis of long-term residence; it's 14 years.

Don't really want to expand on my own circumstances, but let's say I've had my own considerable experience with the UKBA. Best thing I did (apart from seeking legal help) was to get my MP involved as soon as things went unpredictably haywire, who raised the issue with a Home Office junior minister. Although it cost a couple of thousand quid in fees to set right, everything was returned and stamped within about 14 weeks... although I had to sit the 'Life in the UK' test, which meant knowing what to do if someone spilled your pint by accident. :D

As to the topic of the thread, I believe my Kiwi compatriot is a little confused about how immigration works in both countries, thinking that the two situations are comparable, which they most certainly are not. Sorry to hear that your nephew wanted to stay, but if he's been in the UK for longer than the usual two year working visa, he's had a pretty good shot. My sympathy though; immigration headaches can be incredibly stressful and demoralising. Kia kaha.

As far as I am aware, Bulgarians also need a work permit for the UK (with some types of jobs excepted). At present these permits last up to 5 years.

Unlike NZ, Bulgaria is now an EU member state and has freer access to living and working in other member states. Like it or not, this is the law. Similar freedom is awarded to Kiwis who want to live and work in Australia - an advantage not extended to EU passport holders.

I know that our own application for immigration to NZ - admittedly a long time ago - was stringent and reading some of the other replies it seems to have become even tougher.

I doubt that the original poster's relative had to go through anything like that to get a limited working visa. If they wanted to stay permanently why not apply for UK Citizenship?

Whilst we were going through the visa process I often got the feeling that it was harder to get into NZ because we were British! The time, money and awkwardness of it all. :thumbdown:

I'll quite happily be deported though! :D assuming that they pay for your flights back home I'm up for that. :thumbsup:

Ah ! That may have been your feeling but not actually the case. Same rules for all, except that those from non-english speaking countries need to pass IELTS unless otherwise directed and those whose quals are not NZ comparable must get a positive NZQA full assessment etc. Also, those from certain countries may wait a mighty long time for approval. Longer than someone from the UK.

I think it was because every hurdle we jumped there seemed to be another one ahead. It took two goes in the EOI pool before we were picked. Two years later we had the visa.

I think sometimes the UK should be more strict on immigration like NZ.
