Default Question about current tenancy agreement

Hey

This is a question for either you tenants or landlords in the UK who have experience with this

FYI we currently have our application lodged in London and, all being well, are aiming to leave our current house at the end of June to make the big move

We currently have a 12 month Assured Shorthold Tenancy agreement which is due to expire at the end of April. Our letting agent has offered to setup a new 12 month agreement and although this will have a break clause it cannot be actioned in the first six months by either party. I get the feeling they want us to sign up to such an agreement, whereas of course we're reluctant to since we may only need to stay on 2 months after the end of our current agreement

Now, regarding out tenancy agreement, am I correct in thinking that if we don't leave at the end of the contract and the landlord/letting agent doesn't issue us with any notice, we simply roll onto a month-by-month agreement?

As far as I'm aware if they landlord wants to give us notice to leave they must do it with a minimum time duration of 2months... is this whats known as a Section 21 notice?

Hi rick

I think we only had to give our tenants a months notice to leave the house. Though they had 3 months to find somewhere as we were selling it.

When we rented in the UK (a number of years ago), we had a six months lease and then had a rolling monthly agreement, as we were trying to buy at that time.

I'd give your local CAB a ring or pop in, they have specialists in Tenancy law and you can get a definitive answer for free.

Hi Rick78,

Yep, you've got it. Your fixed term contract becomes a rolling contract after it's expiry date, assuming no new agreement has been signed.
