Similar for women on maternity leave, they accrue the leave but it is worthless as the holiday pay is paid on the average weekly wage for the previous 12 months.

My boss wants me to force people to take leave when we are not busy, but I just cant do it.....maybe I am not built to be a manager

Barnsley Mat, you are from Baaaarnsley and you have never heard of the pit/factory weeks? Huge numbers of places used to shut down......until the pits were shut down permanently.
Most of the pits were closed down by the time I hit working age, the forced 52 week holiday. So no I've never heard of it.

Holiday pay is a proportion of total annual earnings and is not based on an hourly/weekly rate.

Holiday and sick pay are usually calculated at 8%. So it often works to peoples advantage for annual leave. The hourly rate for AL tends to be higher than their usual hourly rate. This may be due to working additional hours, a change in rostered hours etc etc.

Aye. That may be true. For Mr BEVS the calculation is minus the part of his hourly rate that is the tool allowance so it works out less. Of course, the enforced unpaid leave also has an impact.

Perhaps this should be amended to read .........

Employees must be given the opportunity to take at least two of the four weeks’ holidays continuously at a time of their own choosing, if they wish to do so.

I'm looking at the wreakage of Mr BEVS annual leave entitlement and have worked out he is stuffed until this time next year unless it is unpaid.
