Using Article 10 Residence Card to enter UK after a no-deal Brexit
 

For those exercising treaty rights in another EU country before Brexit, will it still be possible for spouse or family members to enter UK with their Article 10 Card (rather than a Family Permit) after Brexit?

Amongst the various recent Government amendments to freedom of movement policies and procedures, I have not seen any mention that entry via the Article 10 card will stop.

Also, the Govt web page on "Entering UK with Art 10" has had no Brexit updates, unlike various other Govt pages.

The Govt no-deal arrangements say "The current route reflecting EU law will remain open until 29 March 2022 for existing close family members of UK nationals who were resident in the EU27 before exit."

Perhaps it would it be naive to assume that this means using the Article 10 to enter will continue as normal through the transition period.

Does anyone know for sure?

Good question. Until the government provides more up to date information then I wouldn’t assume anything.

If the UK leaves the EU without a deal

Irish citizens will continue to have the right to enter and remain in the UK without requiring permission.

For the time being, border crossings for EU, EEA and Swiss citizens will remain unchanged.

From 6 January 2020, if you do not have the correct documents at the UK border, you will no longer be given an automatic opportunity to produce the required documents or to establish a right of admission to the UK by other means.

EEA national identity cards will be phased out for travel to the UK during 2020. More details will be provided shortly.

In other cases, find out if you’ll need to apply for a visa to enter the UK.

If you’re a Swiss citizen

If you were living in the UK on or before the date the UK leaves the EU, you’ll be able to use your Swiss national identity card for at least 5 years after this date.

The UK will stop accepting national ID cards for entry to the UK for Swiss citizens who arrive in the UK after Brexit. This will happen during 2021 and we will give notice of the change.

If you’re a non-EEA family member of an EEA or Swiss citizen

You can continue to travel with or join your EEA and Swiss citizen family members in the UK.

From 6 January 2020, you will no longer be able to use Article 10 or Article 20 residence cards issued by EU or EEA member states to enter the UK.

You will not be able to rely on a stamp in your passport showing previous admission to the UK under the EEA Regulations, or an expired EEA family permit or residence card.

From 6 January 2020, you’ll need to show both:

• a valid passport
• a UK-issued EEA family permit or a UK-issued residence card

Find out if you are eligible to apply for a UK-issued EEA family permit.

You’ll be able to use a valid passport and a family permit or residence card issued under the EU Settlement Scheme to enter the UK.

If you do not have the correct documents at the UK border you will no longer be given an automatic opportunity to produce the required documents or to establish a right of admission to the UK by other means.

The Common Travel Area was suspended in 1939 and controls were introduced on travel between the island of Ireland and Great Britain. Will we see that again ?
