usa/uk/irish visa help..forms?

Default usa/uk/irish visa help..forms?

I am a US citizen, my gf + I brought our son to visit my parents for the first time with the plan of returning to northern Ireland (UK) to get married and reside there.

Things changed we decided to get married here and apply here.Am I right in thinking that the forms we need to submit are the I-864 and the I-130 ?

Or are there other also?

There are others also. Go to www.uscis.gov and find a section called How Do I Adjust Status to Permanent Resident?

There have also been plenty of folks on this forum who have done that, do a search on here for AOS or Adjustment of Status.

No he just has Irish passport, but have been advised that I can apply for a US one for him because I am USA Citizen and on his birth cert.

Where and when was he born? If outside the U.S., has he got a Consular Report of Birth Abroad and a U.S. passport?

Is either parent a British citizen and was he born in Northern Ireland? If so, you should make sure he has a British passport too.

He was born in Northern Ireland in 2005, and has UK birth Cert, however holds an Irish passport. He is entitled to dual citizenship to UK/Ireland as is my wife who also travelled on Irish passport.

His application is less complicatced because my permanent adress on his birth cert is my USA one and I can basically apply for a passport for him at the local passport office submitting all the necessary paperwork. (Went to speak with them on Friday an calle INS National Customer service for advice)

It's my wife's paperwork that we got confused about because there are so many forms.

Thanks to the links provided above I think we know which ones we need to submit now

Make sure he has his US passport before you travel.

These people can barely answer immigration questions correctly... I doubt they correctly answered your questions about passports... that's not even their jurisdiction.

I thought the son had to enter the US as a US citizen.
Maybe there is a special exception for an infant?

Suggest before you file anything that you do a one time consultation with an immigraton attorney for their Confidential advice. Your post is froth with areas that might well be seen as fraudulent intent by the USCIS since your GF is here in the US and suddenly decides not to return home to do the immigratoin processing.

You can file on your own but strongly suggest that consultation. Also note that the fees you find now on the USCIS site are only good untl July 30. After that they are doubled if not tripled in some cases.

Sounds more like he entered under the Mother's passport and wasn't declared a US Citizen at the POE. He should have had a report of birth abroad and a US Passport before entering.

Note even though you listed your US address on the birth certificate, the birth needs to be registered abroad at the US Consulate (department of state).

There is no such animal as the INS. It has been changed a while back to the United States Citizenship and Immigration Service (USCIS). Also they do not do passports. There is a separate US government agency for that purpose. Yes, any US citizen can apply within the US for a US passport regardless of their age.

It is not just the matter of forms but also a matter of evidence that needs to be submitted with the petitions, i.e. affidavit of support with US federal tax returns and/or proof of employment and annual salary either of which shows that you can support a family of 3 (3 if there are no other dependents that you have, i.e. children from a former marriage), registered marriage certificate, long form birth certificate for your wife, etc.

They also, despite their title, don't "do" citizenship either. Other than administering the naturalization process.

Questions of United States citizenship fall within the jurisdiction of the State Department.
