should i go?
 
I cant stick this waiting anymore. Should i just go back home before my AOS interview? Im too worried about it. Should i just take my daughter and go? Im worried that if they dont approve me they will not let me take my new daughter with me, because my husband cant look after her. Plus, i want to take her with me, please help!!

Why would you leave before your AOS interview?? Maybe I missed something

OK, this is my 3rd time over here, 1st time i got married. This time im AOS. I had my baby 1 month ago. They are going to think i planned to stay because i came through POE married to a US citizen. If they dont approve me at my AOS interview, i want to take my baby back home. Can i do this? She was born here. I feel they will npt approve me because i came over married on a VW. I feel it is useless to even go to the interview, i should just go home before it gets even worse

Do you have any *logical* reason for thinking this?

You say you're doing AOS, but you haven't said what your current status is.

I filed from a VW, this being the 3rd time ive been here. They prob wont approve me, judging from what ive read on here about filing for AOS from a VW. They will say i should have got a spouse visa. Esp since i was married the 1st time i was here. I dont have any status, i filed the I-130 with the I-485, etc etc.
All i want to know is, is there any point is going to the interview? They will just deport me. I just want to be able to take my baby with me. Can they stop me? My husband allows me to.

Once again, get a consult with a competent immigration attorney. You can get a referral from going to this site: www.aila.org

A consult will put your mind at rest much more than advice solicited from a newsgroup.

Why *didn't* you apply for a Visa when you guys got married?

Did you lie when you came through POE at any point?

From what I understand, if you are a UK citizen and you child's father is a US citizen, then your baby is a citizen of both countries. How they would deal w/a baby going through POE, I don't know... Don't know if s/he would need a passport or what.

Ok, i know my baby is a citizen of both, all she needs is a passport. All i was worried about was that my AOS interview they deny me, telling me i have to go home. i was wondering, can they say at my interview then that i cant take her with me? Or am i being paranoid?

The first 2 times i didnt lie because i came back home, altho i didnt tell them i was going to see my husband. The last time i said i was going on holiday, but i wasnt planning to stay. But then he got a job, and i decided to stay.

Once again, you need a LAWYER. It would benefit you greatly if you looked in the yellow pages or went to www.aila.org for a referral. You may be able to get a consulation for free. This case, if truly the way you have presented it, is outside the scope of this newsgroup. You need a LAWYER. Good luck.

Why would Immigration stop you from taking the child with your husband's
permission? You child, is a US citizen, and is permitted to stay in or
out of the US. Why would this be up to immigration?

You know if you look at the immigration statistics, MOST spouses of US citizens AOS from some other status. Those of us here going through the K1 and K3 process only constitute 8.5% of all spousal immigrants. I think you are getting worked up before you need to be. Chances are you will get your AOS. I heartily second the opinion that you hire an experienced immigration attorney. When I practiced law, I represented a couple with a Turkish husband who had overstayed his student visa and was working. He was faced with deportation but it all worked out for them and with any luck, it will work out for you too.
