Moving back to U.K. with NZ spouse
 
Hi all,
We are originally from the UK & have been living in WA for 11 years & are planning to move back home next year. Our daughter wants to come with us, she is a nurse & married with 3 children all born in WA. Her husband is from NZ, what is the processs

Presuming that your daughter is a British citizen (you say you and husband are from the UK and imply she was born in the US so sounds as though SHE is British by descent) then SHE has to sponsor her husband AND the three children (they do not have British citizenship) for settlement visas for the UK. If your daughter was born in the UK then the children would be eligible for Brit passports and she would only have to sponsor her husband - please confirm which it is.

You (the parents) cannot sponsor or provide third party support.

Alternatively if the NZ husband has British grandparents or European ancestry there are other options.

In this case, per the OP's posting history, "WA" is Western Australian, not Washington state.

The daughter's husband should look at his family history to see if he is eligible for an ancestry visa, which would be a cheaper and easier alternative than a spouse visa.

The OP said they'd been in Oz for 11 years but the daughter is a nurse with 3 kids so must be considerably older than 11. :homy:

I think she is likely UKC otherwise than by descent and her kids are so by descent.

Agree on looking at ancestry for the NZ husband.

In that case the daughter only needs to sponsor her husband as the children can get British passports.

All other things I said, still stand.

Reading the financial guidelines to which I provided a link, will tell he how she can qualify.

..... With Irish, Italian, or perhaps Hungarian being usually mentioned as the easiest to obtain based on ancestry. :nod:

Given the favourable exchange rate just now, the OP's daughter should consider getting British passports and consular birth certificates for all her three kids.

Another point - the OP and family members from the UK should think about applying for Australian citizenship before returning to the UK if they have not already done so.

If, as now appears to be the case, the children are British citizens by descent, they pretty much need British passports, otherwise they will be stamped into the UK as visitors when they arrive, which will cause all sorts of administrative problems.

We are Australian citizens, our daughter is in the process of getting hers now, thanks for your help.
