Hi everyone

i posted earlier this year and now have some more clarity on my situation

I am now engaged to my American girlfriend (I’m British) and we plan to have a quick wedding in April in NYC so we can begin the process for spouse visa and live in UK. seems simpler than going for a fiancé visa in order to marry in UK. The goal is to live in UK as soon as legally possible

in the meantime my girlfriend in here in UK with me and has been for 3mths. She will go home end of August and come back mid September for 6 more weeks. She will spend a total of 5mth in UK during 2020. She currently works from home for a US company.

we are ensuring we do not extend beyond 6mths, but are we doing anything wrong with the above plan and any advice and tips on visa application?

Has she been working remotely from the UK for her employer?

Is she in the UK currently as a visitor or does she have a work visa to work for her US employer in the UK?

So she would have been here for 4 months, then wants to come back after only 2 weeks? Sounds like she is trying to live here, by pretending she is a 'tourist' as she clearly is not. If they do their job properly at the border she will be refused entry and sent back, and rightly so.

Your plan for the wedding sounds fine. Get married in the US, YOU return to the UK and start the visa process.

Just another point; I don't see that your girlfriend's intended travel in September back to the UK is essential travel.

The US Government, with the high surge of new Covid cases in the US, still has a no travel advisory in place.

She should stay in the US.
