Default What about paying tax when you go back to the UK

Hi there - I am new to this forum - am quiet active on Expatwoman, done some browsing on here before, but only just joined.

What is the deal regarding going back to the UK and tax? We left the UK mid june 2007 and are looking at leaving dubai (yipee) june 2009 - so we have been out of the uk for 2 years. We never declared ourselves as non-residents or anything....am getting a little worried!

Any advice would be great.

Provided you were in the Uk for no less than 90 days during the two tax years in question, you will have no UK income tax liability in overseas income during these two years. Although you ame out after 6th April 2007, I have assumed you spent no more than 90 days in the UK, in that tax year, in total.

If you return to the UK in June of this year, income earned from 6th April until departure is liable to UK tax, as you will become UK resident for the tax year 2009/10.

You should have completed HMRC form P85 to declare yourself non-resident, although HMRC will eventually sort matters out. Upon taking up employment in the UK, you will be put on (punitive) emergency tax codes until HMRC works out what you owe. Suggest you complete HMRC form P86 when you return to get yourself back into the system.

Hi Meow! Thanks for the reply! I wondered what happened to you on EW

I made a mistake (just checked dates) - we in fact left the UK on 25 July 2007. Spend about another 2 weeks there over xmas 2008. This means we did indeed spend more than 90 days in the UK during the 2007-2008 tax year.

As to the income earned post April this year (2009) - this means income earned in the UAE? I have not been working since last october (baby born!) but hubby has. This means they will tax us on his earnings in Dubai from April?

If you're declared tax-resident then usually you pay tax on all income whereever it's sourced from unless double-taxation agreement applies. Even if there is one between UAE & UK it won't be relevant since no income tax in UAE.
