Thank you Meow.

Possibly stupid question but when/where is this Statutory Residency test done? He is adamant that he won't be paying any tax and this is all completely worthwhile but to me reading that it looks like because he has significant ties in the uk then he can't be here for hardly any time at all?

Ive been telling him for weeks to go and consult a local tax expert but he is not listening...will work on him some more.

The "test" applies with immediate effect. You and the house (available accommodation) are connecting factors and that will limit the time he can spend in the UK. Working abroad doesn't mean anyone is automatically exempt from UK income tax, no matter that ill-informed recruiters may tell people.

If he takes advice from someone in the UK, please ensure that it is someone familiar with the rules regarding working abroad. Most UK accountants don't deal with this area and are not up to date, ditto many tax advisers as they mainly advise UK businesses. It's a specialist area and I've had to correct much misleading "advice" over the years.

As a non-resident Brit in M-E, should I be claiming child benefit for my 16 year old (over here with me)?
Can it be backdated?

No - if you don't reside in the UK you should not be claiming child benefit. Unless the rules have changed... (and even if they have, I very much doubt they are changing to allow this).
