Non resident 90 day rule & hotel quarantine
 
Does anyone know if the enforced 10 day hotel quarantine for travel from red list countries is exempt from the 90 day non resident tax rule? I went back to the UK in July and had to sit in a room for 10 days and want to know if I need to take this in to consideration for this tax years allowed days.

Thanks for the reply. I have read of several of these summary documents and none refer directly to the hotel quarantine so I am still unsure if these 10 days are classed as exceptional circumstances or not.
I don't fancy getting to the end of March and finding I have spent a few too many days in the UK so have a tax bill to pay!

Just managed to get hold of someone at HMRC and he explained that any quarantine i have had to do does not count towards my 90 day non residency limit. So that's a bonus.

All HMRC have done to date is to clarify that Covid-19 might be considered an Exceptional Circumstance under existing legislation. Whilst you might be able to discount up to 60 days from your presence in the UK count, those same days might still affect your residency status for the year in many other ways, for example: days working in the UK, days present in a UK home, gaps in overseas employment, working sufficient hours overseas etc. As usual, this will all be down to an individual's personal circumstances and getting professional, specialist advice usually a wise move if there is any doubt.

Please be advised that the area of Residence is complex and is very important that it is handled correctly. ​​​​

Tax legislation is ever-changing, HMRC's literature on this is in excess of 100 pages for a reason!


As Johnnyboy11 has said, you should seek professional advice.
