Although the employer also saves in that they do not pay the Employer's contribution it is the Employee's obligation to present the case to the HMRC. The decision as to whether or not you are classified as normally resident or not resident is made by the HMRC and is dependent on your circumstances, which are not known to your employer (and even if they were they cannot be presented by the Employer to HMRC ). Only you can give personal details on your life style to HMRC.

If you want to save paying the NI for the first 52 weeks then you will have to make the case to HMRC to be classed as non resident by HMRC.

If you don't want your employer to deduct the class 1 then its better to deal through with the IRD through your HR department which I did before. The IRD aren't the problem. The employer is the problem because most of them don't know what they are doing.
