You need a labour card etc so I doubt you would be able to do as you suggest above. If a company is caught doing something dodgy, they get fined big time!!!
I'll ask my HR peeps what is the latest stance on it.

BC is correct as above ... they tightened up the laws not so long ago and for some mad reason seem to want to make it even harder to move.

As per UAE Labour Law, if you have an NOC and leave as a good leaver, then you have no ban.
The years service thing was dropped at the beginning of this year, so in theory having done less than a year makes no difference.
I've just made the jump after only just a year, finally managed to get an NOC (it's amazing how an MD will crumble after a stern conversation from someone with huge wasta will do) and the visa transfer is fairly easy.

So ... as you can see, there is no clear cut answer on ways of getting around the ban. They are up to speed with all the latest rules and regulations as we hire newbies each week.
Any chance you can stick it out for another 12 month ... or is it beyond that now?
The labour dept will put a ban on him as it is under 12 months. There is never any assurance that the next visa will go through if the next company tries to pay out the ban. There are also other factors such as how many times the person has transferred visas. Or how the Labour deptment worker feels on that day!

an engineer left the country to go back to the uk to live, been here many many years but moved within the same company, but he was still issued with a ban on exit, even though he is in one of the 'exempted' categories! depends on the mood and what time of day etc whether the full moon is out as well helps.

Surely there are ways round these things, for instance, can't a company register you as working in another country such as Oman but you still work in Dubai? Or, can't you just work on a visit visa for the time being?
I don't understand the mentality sometimes, my company doesn't issue NOC's at all so i'd be pretty much screwed.

visa runs are going to be stopped (allegedly), they are expecting people to arrive on a work visa, can't see that happening

I can kind of see their point. Although it's illegal, plenty of companies refuse to process residency, work permits etc for new staff until they've passed their probation. Now they'll be forced to do it properly, which is no bad thing.

Unless I'm missing something here, surely it's actually going to be very easy to enforce? When someone rocks up at Immigration asking for their visa status to be amended, the officer just has to look at when they left the country, and if it's less than a month ago, they can't come in.
