You are right. That has been the case every year since the 'rent laws' were introduced. We had an increase of 5% last year, he wants another 5% this year, I'm waiting for the 2009 rent law. Why can't they announce it by 31/12so that everyone can get on with renewing their contracts

My understanding of the rental law is as follows:
Your landlord is permitted to raise your rent 5% every OTHER year.
Eg.
Year 1: Price X
Year 2: Price X
Year 3: Price X + 5%
Year 4: Price X + 5%
Year 5: Price X + 5%
Year 6: Price X + 5%
Year 7: Price X + 5%
Does anyone else have the same understanding?

Let's hope the official announcement reads otherwise.

How will it work for our 14th renewal in 2009?!! I have to deal with the added pressure of hubby wanting to sign and just pay up; he thinks I'm just out to cause trouble.

Perhaps you can get them to stick to the 2008 rental law, as the 2009 law hasn't been published yet?

I thought it was no increase in the second year and then 5% every year after that. Which I think is what Blue Cat was saying.

Which means no increase for us. But he wants to increase rent by 5% plus has added (new) a further 5% as 'service charges' - fat chance he will agree to a nil increase unless the 09 law compels him to. The waiting game begins.......

our new lease has included a 5% increase, I think that will probably be what is announced. As for service charges they can't charge you this as you don't own the property.

BC - was your rent increased last year too? The rule in 2008 was that if there was an increase in 2007 then no increase in 2008 if not then 5%. Similarly for 2007, we didn't have an increase because he had increased it by 7% in 2006.

I'd guess at a 5% cap- and the sooner the market stabilises so we don't have to go through this performance every year the better. (I say that as a landlord by the way.)

no because we were in the 2nd year of our lease, there is no increase in the second year. Yours will be increased every year by whatever the government declare.
