DUBAI RENT CAP 2009 - is there one?
 

I have not seen any news on a rent cap for 2009. Is there one or will landlords be able to increase as they see fit?

announcement is usually a few days before the new year, or in true UAE style, a week or so into the new year, just to upset those that have already signed/paid.

what is the law for 2008? is it 5%?

a lawyer sent me this today

NEW DUBAI TENANCY LAW

1. This is the first Tenancy Law of Dubai, came into effect from 29th February 2008

2. Applicable to all properties including open and agricultural lands, excluding Hotel Establishment
3. Tenancy contracts should be registered with Real Estate Regulatory Authority (RERA) and the Rent Committee will not entertain unregistered tenancy..

4. . Contract cannot be terminated before its expiry

5. . No increase in rent for the first 02 years (Article-9) and thereafter it can be increased on mutual agreement and in case of dispute, the Rent Committee shall determine the rent in line with the comparable properties of the neighboring area.

6. . For non-renewal of tenancy, 90 days notice should be given by the concerned Party. before the expiry of the tenancy. (Article-14)

7. . GROUNDS FOR EVICTION

a) fails to pay rent within 30 days
b) Subletting whole or part. In such case sub tenant can be evicted
c) Uses for other purposes
d) For renovation which cannot be effected without eviction. In such case technical report of Municipality is required.
e) For demolition
f) For the use of owner or his first degree relatives

8. NOTE:

a) If eviction is effected for reconstruction, renovation or maintenance, the tenant has the right to get it back for a rent comparable to other neighboring buildings

b) If evicted for own occupation, he should not let it out for others atleast for one year; failing which the tenant can claim compensation

c) after 02 years no cap for rent increase

d) eviction is possible

I take it you have been in your property for 2 or more years, so he is going to try on the big rent increase with no cap..

Was it on any kind of headed paper from a government entity, or on the back of a McDonalds wrapper?

one property 1 year and the other 2 years. one he is demanding more than a 10% hike

you could not fit all of that on a mcD wrapper, could you?

they way they write contracts here, they could probably have fitted it on the ketchup sachet..

After a 5% rise last year, my Landlords have today imposed a 10% increase for this year. Although I feel its still reasonable (80K for a 3-bed villa in Al Garhoud), my boss is reluctant to pay. He thinks a new lower rent cap may soon be introduced. What does the team think?

Thanks but my boss read this story and took it to mean that no decision has yet been taken about the 2009 rent cap.

the story says the 2008 law is enforceable until a new law overrides it.

So at the moment its 5% as per last year.

The law says until further notice it is 5%. You have a good deal anyway.

But those poor buggers who rented last year...well the price will go down now anyway

Am worried the RC may do something stupid and remove the cap altogether and seek 'market rates' that are over inflated in any case. Guess I'll just pay the 5% and get on with it. But firstn will get one of my Arabic speaking colleagues to call them up and find out what they have up their sleeve. Will update later.
