Default Dubai Court rules employer cannot extend employee’s probation

This is important folks....

Emirates 24/7

The employer has no right to extend the probation period of an employee beyond the statutory period of six months, according to a new principle laid down by the Dubai Court of Cassation.

The court said if the employer has not used his right to end the services of the employee within the six months set by law, he has no right to extend the employee’s probation period any further.
Court of Cassation is the highest Court in the land.

It would be important if the concept of precedent existed in the UAE...

UAE Labour Law has always said probabation is for a maximum of six months and cannot be extended, so no change.

No. The law in the law, just some break it and don't care and get away with it. Government employers are also exempt from UAE Labour Law.

Do we live in the same country? The same one where being gay gets you a longer sentence than beating a pregnant woman in public?

Laws that are no enforced and upheld may as well not exist.

UAE Labour Law applies to most employers and most will have the MoL giving them a hard time if they do not comply. There are a few who ignore and get away with it, but that doesn't mean there is no law or it is never enforced.

Clearer to you now?

No idea what you first sentence has to do with labour law.
