People....

Back in South Glos now. Those of who who read the Kaleej Times would now that anyway!

After mising flights, leaving hire cars at the airport double parked by departures and tears at the aiport (meaning me not Kristy, yes I am man in touch with his emotions and not bent) I have returned the country residence in the South Glos countryside.

Happy Christmas to all and have a good one on the sandy city... back before New Year so will see the relevant parties when back....

Please accept without obligation, implied or implicit, my best wishes for an environmentally conscious, socially responsible, politically correct, low stress, non-addictive, gender neutral, celebration of the winter solstice holiday, practised within the most enjoyable traditions of the religious persuasion of your choice, or secular practices of your choice, with respect for the religious/secular persuasions and/or traditions of others, or their choice not to practice religious or secular traditions at all ……….

Unfortunately with respect to English Law being applicable in the Emirates.

All emirates except Dubai, Fujairah and Ras Al Khaimah have adopted the federal system of courts. In Dubai, local courts have been retained. There are civil, criminal and Shari'a (Islamic) courts of first instance. All decisions may be appealed to the Dubai Court of Appeal. Thereafter, a final appeal can be made to the Dubai Court of Cassation.

The civil courts ( as opposed to the Shari'a courts which deal with, among other things, matters of personal status and inheritance regarding Muslims) have exclusive jurisdiction over financial transactions, insurance, ownership of vehicles, carriage of goods, and personal law for non-Muslims.

The language of the courts is Arabic and although the recently implemented provisions of Federal Law No. 93 of 1991 restrict appearances before any court in the UAE to UAE national lawyers only, all lawyers already licensed to practice in Dubai may continue to do so by virtue of Law No. 5 of 1996 issued by the Dubai Government.

There are a number of European (primarily English) law firms operating in Dubai which are available to advise on Commercial matters such as the intricacies of appointing an agent, or establishing a presence in Dubai, joint ventures, financing and energy. In litigious proceedings they will liaise with Arab advocates on behalf of the client.

The requirements of the Department of Economic Development, Dubai Chamber of Commerce and Industry, Federal Ministry of Economy and Commerce and other local and Federal authorities frequently change. British businessmen and women coming to Dubai should therefore take independent legal advice on the matters described in this summary.
