I-134 for K1 visa.......I THINK though I havent yet got round to this .....that AOS may require an 864. (incidentally the dumb attorney we hired held things up by asking Julie to prepare an 864 unnecessarily for the initial petiton........that was shortly before we sacked him)

Actually it depends on the US Consulate. There are a relatively few that require an I-864 instead of the I-134. Provide them with whatever they ask for.

Thanks folks.

I just sent I-134 in case they ask for it. I already sent I-864. I guess that way we are protected in either situation.

When do they ask for it? During submission of packet #3 or later?

Hi,
If I understand your post correctly, you shouldn't have sent in the I-864, you take it with you to the interview. If I were you I'd take a copy with you in case it gets lost at the INS, and possibly even contact them to explain.

The important to do is send them what they ask for.
In addition to the I-134 or 864, that may be W-2's or tax returns and
other documents.
You MUST find out from the consulate exactly what they want.

Default The Request will be in the Packet 3

Saha,
I thought the same thing so prepared both. My wife received Packet 3 yesterday from Montreal. They only requested I-134. Your spouse will receive a checklist (the checklist details everything) with Packet 3 detailing what needs to be sent in to the Consulate. I am pretty sure you need the I-864 down the road at when we finally get our spouses to the green card stage.
Best of luck,
Geoff
