ok , I'm a Belgian Citizen , my girlfriend is a U.S citizen , and we
would like to get married . As far as i understand , there's no
problem getting married , but i see there are different way of
becoming a permanent resident of the .
So what is the best we can do , Should i go up there by a travelling
passport , and marry her , or should i just begin from the beginning
and let her file the petition for ALIEN FIANCEé ?
My girlfriend is pregnant , so i just want to be there with her ASAP ,
and being able to work .
Will they allow if we get married to let me stay in the US , while our
case is panding yes or not .
If someone of you all have known people from BElgium doing teh same
thing , i woul dlove it to have a talk with them about How they did it
or what the best solution is for us .
I don't have any kids to bring over to the US AT ALL.
Is there any difference between K-3 and Alien Fianceé visa ?
m kinda confused between those 2

Donny, I think in Belgium you can do DCF. Let me do some looking around for you and I'll post back here later.

This is what's referred to as DCF (Direct Consular Filing). It is the fastest, easiest way, which if approved will let you enter the US as a conditional (because married less than 2 years) permanent resident, and gives you immediate permission to work in the US.
You do need to call/email/fax the consulate though and ask them if your fiancée (the US citizen) needs to be a resident of Belgium to qualify for DCF. (Unless someone on here knows for sure?).
This line on the website puzzled me a bit - ''proof that the petitioner or beneficiary are legally residing in Belgium, e.g., identity or residence card''. It doesn't say petitioner (fiancée) AND beneficiary (you), which leads me to believe that only one of you needs to be a resident (being you, in this case).
That is however just my taking of it. Get in touch with them and make sure! If they will allow you to DCF (you're gonna have to get married first), this is by far the best way to go. Good luck!

And she is going to have to go to Belgium, correct? If she got pregnant this summer, you need to start this soon because the further along she is, the more uncomfortable to dangerous travelling becomes. It is a wonderful option open to you, good luck with everything.

last spring/early summer DCF in Belgium was taking 2-3 weeks. At that time
the American spouse did not have to be a resident of Belgium.
You need to check if that is current.

to mention , IT IS ME WHO WANTS TO GET TO THE STATES , NOT HER COMING
TO BELGIUM ..

Donny, she only needs to come to Belgium to file the petition. That's all. If it only takes 2-3 weeks like Eileen said, and even if it takes double that time or triple, you're a heck of a lot better off going this route than any K1 or K3 visa, especially since your fiancée is pregnant. Email me if you want to talk about this in Dutch.
