Default What Should We Do - Tell The Truth Or Lie?

It would take an awful long time to explain how I got to this point, so in
the interest of getting to the point, I will skip it. The crux of the
matter is that I married a wonderful woman who worked as a prostitute when I
met her. We fell in love. We want to have a life together. My
understanding of the immigration process is that if they even suspect she
worked in this field and even without proof, they can bar her from obtaining
a visa. Worse yet, if she denies it and gets caught in a lie, then she
would be barred permanently from coming to the United States. On the other
side of that coin, if she comes clean and admits everything, they still
require her to be barred from entry for 10 years. My wife has never been
arrested and never been in jail but would be barred for 10 years anyway.
There really is no "paper trail" of her "crimes".

Does anyone know how the waiver program works and even if she would qualify
if she were to come clean and admit everything and just put the cards on the
table. This is what we would want to do. If we lie, then we'll spend the
rest of our lives looking over our shoulders to see if somebody found out
she lied and is coming to deport her.

We want a life together now - not in 10 years. We were married earlier this
year in her country and have already started filing the I-30 and K3
paperwork. We haven't got to the point of no return yet by saying anything
false and having to live with it - but that day where we have to decide
which route to take is fast approaching. I am starting to have sleepless
nights debating this in my mind. Here are the alternatives as I see them:

TELL THE TRUTH

(positive)

Won't have to look over our shoulders the rest of our lives.

(negative)

We are totally at their mercy. They will deny the initial visa application
and we will have to apply for a waiver. Which wavier(s) can we use - don't
know. How long does it take to process a waiver - don't know. What are the
odds of being successful - again don't know.

LIE ABOUT HER PAST

(positive)

No paper trail. They cannot prove she worked in this field but only suspect
it.

(negative)

If she gets caught in a lie it is a permanent barment.

If they suspect her then they could bar her although it wouldn't be
permanent and we would have to go the waiver route (if that is even
possible).

I would be interested in hearing your thoughts. What would you do in my
situation? Am I overlooking something? Is my understanding of the process
correct? Does anyone have any similar experiences they would be willing to
share. I am even considering moving to another country if the visa gets
denied so I can have a life with her. I have no idea how I would even go
about doing that - but trying to think about alternatives. Thank you in
advance.

You don't happen to be that other troll that used to post from Comcast,
are you? In case you are serious, where do you see that being truthful
will result in a 10 year ban? I thought a 10 year ban was for an
overstay of 1 year or more. Moral issues can result in never being
permitted to immigrate, not just a 10 year delay.

ITB,

You need to speak with an experienced immigration attorney, experienced with the consulate where your finacee will be applying for her visa. Not to determine whether or not she should tell the truth, but to decide what will be the most effective way to handle her case.

Regards, JEff

If this is a real person asking a question for a very serious event happening in his life .........
And if this is a troll then you are just encouraging them.
If you have seen something in this post besides it being very unusual, I don't think you have any reason to trash the OP and make a mockery of his life. That is not the reason posters come here to get information.
I have very much respect for the service this MB has provided me with, I would go as far as to say it played an incredibly important role in helping me bring my Fiancee(now my wife) here and helped console me when times were tough.
I am not impying I am a saint, I speak up when I see untruth and incorrect information, based on my own experience. But I do not trash posters without justification just for kicks, that is what the trolls do.

Thanks,
Jeff

i totally agree with you jeff... he came here and asked for someones help not to be made a fool of... its his business what his fiance did NOT OURS! he just asked for intelligent adult advice and some of you just want to have fun on his behalf ... as for the original post i think you should go and consult with an attorney , i personally dont think they can ban her because of her profession ., but then again i am not an expert on this thing ... But calm down i am sure there is an easier way around this than you are thinking ...

If the OP was not answered almost immediately by elviswasmdad (aka Dave W, supertroll) I would be less skeptical.
If the OP is sincere, in his place I would be re-examining my relationship very seriously. You are between the sword and the wall IMHO, and all indications are that YOU will lose anyway it turns out.

I am 99 44/100 percent sure that the OP was the normal troll that posts
here from the same ISP under different names. One way to look at this,
is that it is the only post I can find in groups.google.com for his
email address, [email protected]. Additionally, it seems to fit a
pattern. One other thing to note... If it is not our business, why bring
it up? Once he brought it up, he made it our business. Finally, yes,
they can ban her for being involved in this profession as morals
enforced for immigration are much higher than those required to become
POTUS. (For a definition of "POTUS", please watch Season 1, Episode 1 of
The West Wing. "POTUS fell off his bicycle" was the message sent by text
pager to his staff)

There was no humor - nor was there sarcasm in my original post. I do not
know why some responders think I am joking or want to make fun of my
situation. I am trying to hide my identity because quite frankly I am
scared. Thank you to those who have offered some advice. I know that my
post is unusual - but I cannot believe I am the only one to walk this path
and that is why I am asking.

Yes this is a real person - and these are real questions.

Sound advice was given. Consult an attorney.
Lying is not recommended.

Your situation is not that unusual. I have worked in south America and know of this happening many times. I asked my now wife upfront and early in our relationship is she had ever been a prostitute. Although she had not, we both know of several situations similar to yours.

Consult an attorney. I know only of people who have had success in being deceitful. Mr. F had mentioned a case with immigration and a former prostitute some time back.

I suppose a lot may hinge if she is on "record" as a prostitute.

Good Luck,

Even if this IS a troll post someone out there has this question I am sure.
