What IF LPR that is married to a B2 overstay spouse applies for N-400?

Arrow What IF LPR that is married to a B2 overstay spouse applies for N-400?

I notice that on the N-400 there is a section where it asks the immigration status of the citizenship applicant's current spouse. What should be put if the LPR's spouse is a person who has overstay his/her B2 visa? Would USCIS initiate any action against the LPR's spouse such as removal proceeding or even accusing the LPR of harboring an illegal alien?

Hi:

You put in the truth. I've never seen them start removal proceedings or go against the applicant -- but one never knows.

I don't have personal experience with this, but my guess would be this:

TELL THE TRUTH

Generally lying to the USCIS is frowned upon.

Hi:

They ask, you answer. In my past experience, it has been no problem. In fact, I recall one interview where the DAO commented "I assume you'll petition for him when you become a citizen."

It is actually a common situation.
