We are all ready to file.....But one last questions
We have all our files ready and still wondering if we should retain a lawyer(which we really couldn't afford) to represent us. my husband is overstayed on his student visa for about 2 years and has been working and making wages. Should this matter?
The forms seems to be very easy and we had very little trouble filling them.

The choice is TOTALLY up to you. Many people do this by themselves with no problems. Others trip over things they were not aware of. Also, don't assume that the government people know what they are doing -- they quite often don't. I have experienced many instances where an examiner brings up something which I know is wrong -- and I'm in a position to fix it -- howerver, you will probably not know its wrong and try to play along.
Based upon what you say, if the only adverse factor is the overstay, you are LIKELY to be just fine. I want to emphasize that I have not seen your paperwork and I am in no position to give any definite opinion.
Good luck. Again, the bottom line on your question is that it is entirely your choice.

When applying for employment, did he sign a I-9 indicating he was
legally entitled to work in the US at a time when he wasn't?

When applying for employment, did he sign a I-9 indicating he was
legally entitled to work in the US at a time when he wasn't?

He did not sign anything expect receiving of his employment handbook

By law, you are generally require to submit form I-9 to your employer

Does this make difference when we apply for AOS?
i just checked with him and he said that he did not have to sign anything. He had to show his ID and SSN (which he used his taxpayer ID) and that was it. No I-9 was signed
