how do i go about gettin an Interim Ead in baltimore?
it's been over 90 days, and i want to apply for the SS# as soon as possible. Also can anyone tell me if Passport, EAD, i-94 is all i would need at the SSA office? edit: i got my AOS interview date for mid-april, already got the fingerprints. no ead appt. |

Carry proof of your I-485 I-765 applicaion such as NOA or whatever receipt they sent to you. Also make sure if there is particular day when they handle interim EAD appointment/walk-in

Regards Dhabud They took a copy of what I had sent to Vermont and said I would get notification in a few weeks, and I asked repeatedly for an interim one. Will have to look and see if there is certain days. and Her, when did you send all your paperwork in.. they have only just transferred my application for AOS to Baltimore last week. Just thought you mighit like to know that.. I hope you get on better, and let me know if you do! My original application was sent in Oct 21st last year and Vermont are still on Oct 6th or so. |

With Baltimore it will be interesting to see what happens. If I were you I
would take a copy of the I-765 with you where it says you are entitled to an interim EAD and you can also find this in the law if you dig around on the USCIS website. I would contact my spouse's representatives ASAP if they refuse to honor this part of law. The district director shall adjudicate the application within 90 days from the date of receipt of the application by the INS, except in the case of an initial application for employment authorization under § 274a.12(c)(8), which is governed by paragraph (a)(2) of this section, and § 274a.12(c)(9) in so far as it is governed by § § 245.13(j) and 245.15(n) of this chapter. Failure to complete the adjudication within 90 days will result in the grant of an employment authorization document for a period not to exceed 240 days. Such authorization shall be subject to any conditions noted on the employment authorization document. However, if the director adjudicates the application prior to the expiration date of the interim employment authorization and denies the individual's employment authorization application, the interim employment authorization granted under this section shall automatically terminate as of the date of the director's adjudication and denial. Baltimore is very slow in processing EAD but the opposite with AOS interview (4.5 months from Baltimore receiving files)
I got my EAD on February 12, 2004 while my file got transfered from VSC on October 30, 2003 (approx. 102 days). You don't need your EAD once you get the AOS stamp. In fact INS takes your EAD card after the AOS interview (assuming it went on well). I hope my timeline will give you an idea about Baltimore office.
10/12/2003: Mailed 765/130/485 to VSC 10/24/2003: Received letter from VSC confirming receiving 765/130/485. 11/04/2003: Received letter from VSC that my files were transfered to Baltimore on 10/30/2003 12/2/2003: Finger print notice from Baltimore office received 12/6/2003: AOS interview letter received. AOS interview 3/16/2004 12/20/2003: Completed finger printing 12/27/2003: INS received finger printing results (Found out by checking 485 status on the INS web site) 2/6/2004: Received EAD appointment letter. Appointment on 2/10/2004. 2/10/2004: Went to Baltimore and got EAD. My experience: got there bright and early, about 6.45am and i was maybe the 10th in line. Doors opened at 8am and we were security checked then we took a number and a seat. Waited 2 hours to be seen.......... number was called and I went to the window........... told the Lady it was my 91st day and she knew exactly what i needed.......... took a seat, then got my fingerprinting and picture done........... took a seat........... got my card........ left.......... went and had Breakfast :D The card is valid for 8 months which i was suprised at! I was expecting only 3 months! The only things i needed was my receipt letter, copy of my EAD application that i submitted last year and my passport. Lee........ its worth another go! If you are going to make another effort try telling them how important is for you to work (economic reasons). Make sure all your files are get transfered to Baltimore. It does not serve your purpose if they catch dust in Vermont. Best wishes Kenny |
