Hi all, just a quick enquiry. I came to US(Seattle) in December to be with
my US fiancee at her best friends wedding over Christmas. I came in on the
VWP with no intent on staying and marrying . Things came to head with all
the romance of the wedding and I proposed and we got hitched two weeks ago.

Will I be able to file AOS in US ?or will I have to go back to UK and file.
We have no problems with co-sponsors as her parents would definitely sign a
supporting document for us. What to do about such things like police check
medical
Also I(we) are worried after reading some postings to this NG that the INS
will frown upon us as we have been seeing each other for 3 years since she
went to the UK to study for her MSC, because they will make it out like I
lied at POE and had every intent to marry and stay.

Can anyone offer any advice on AOS , what is my best course of action now
and how quickly if at all will I be legally able to work. Any advice would
be appreciated.

Hi Scarlett,

There are a couple of ways of doing it but the easiest would be to go start/run then enter cmd (win 2000 and above - win95/98 enter command - if you are using linux you are already a geek and will know how to do this)

then enter "tracert 62.30.197.254" on the command line

you can do it the other way round as well, if you know the url for a website you put the "tracert (url)" and you will get the ip address.

If you know the url and just want the ip address then do a nslookup (and visa versa).

Nice to know you know nothing, I presume you are one of these people that
shoots everybody down.Please dont post to my questions again as I still use
a web based email service from blueyonder in the UK, oh grrrrr you have made
me really mad and all I hope is there are people more helpful than yourself
out there. I dont think I will use this newsgroup again as I am settling down here quite nicely thank you.

There are too many people with suspicious minds here lol. Sadly you posted a topic that does annoy a lot of people, marriage on a VWP is often scorned upon where it has been used to avoid the I-129f route. It frequently surfaces and where fraud is concerned many of us have no time for those who post. By the same token there are those who do this on the spur of the moment, and good luck to them.

I cannot comment on your IP address and dont really want to, you posted here to find information and you deserve the right to hear from those who care to post, if the poster of the IP location is incorrect I am sure he will be the first to appologise.


Most of us have all gone through the I-129f route, but all are in a similar position where we want to be with our loved ones so we cannot discriminate. So far as your topic is concerned, file for an AOS, many people have done this and i can't recall one that went tits up, so i am sure you will be just fine.

Finally, it would be sad to lose you from this forum because of a pointing finger, I would suggest that you will be hard pressed to find a better place to be,

You are here already. The deed is done. You are now Mr. and Mrs. in the eyes of the law. Do you have to return to England? No, you don't. You may file at your local INS office for your adjustment by filing forms I-130 (Immediate Relative Visa), I-485 (AOS Application), I-864 Affidavit of Support, I-693 (Medical depending on office being used), I-131 (Advance Parole if no overstay issues in your background) and I-765 (Employment Authorization) and 2 G-325A's (one for you and one for her). Depending on the INS office you will be using the EAD will take at maximum 90 days from acceptance of your application by the INS.

Touching briefly on the subject of your entry into the US under the VWP, the issue is of a serious nature. From reading the long and informative and often heated threads of late on this subject, both you and I can see that the issue of INTENT when you entered is of paramount importance. And that intent is fraudulent if you entered the US for the sole purpose of marriage. I don't know what occurred when you entered at the POE. Don't have any idea what was asked of you nor what you answered. I can't read your mind and don't know what your intent was at the time.

Is this issue only important on the day of your entry if your intent was solely to enter, marry and stay to adjust and you deliberately concealed this intent at the POE or does that intent and concealment follow you through to the AOS interview. I've yet to get a clarification on that, or at least have it clarified so that I can respond to you or anyone else in an inteligent manner within the legal scope of INS law. You have asked a question, however, and should be answered as to what you need to file which I have done above.

My suggestion is before you file for your AOS, have a consultation with a very good immigration attorney and get his/her educated opinion on the right course of action for your own situation.

Hi Alan,

isn't Seattle a great place to live?

I am in about the same situation, married on VWP, applied for AOS in Seattle in October 2002.
Getting Employment authorization and Advancd Parole took me about 2 months from application date.
During this time I went to the INS twice to check the state of my applications, especially because i urgently needed the AP.
The only negative experience I had with Seattle INS was that 2 sets of pictures I sent in got lost.

My suggestion is to file for AOS go there in person. Best time is early in the morning.
If there is a long line in front of the building it may be better to go there another day.
I found the officers always most helpful if there were no others waiting.

To work you probably need a Social Security Number.
After I received the EAD I applied for that at the SSN office in Burien, as it was the closest to where we live. It took them 6 weeks to get it doublechecked with the INS and send me the card. You may try a different office.

All in all from filing to being ready to work it was about 3 1/2 months.

Hi there
I also married in Seattle while here on a visit visa. In this case a B1/B2 while I was here for a business visit.

I had no unusual problems relating to the AOS process, other than its drawn out nature and a reluctance to use the AP I was belatedly granted.

Contrary to the previous advice, I would not file in person unless you were worried you didn't have the right paperwork.

We did so, and the paperwork was erroneously 'split up' and sent to Nebraska which resulted in various strange demands from the INS. They said it would have been better if I had submitted the whole envelope via mail.

In my experience, Seattle INS is relatively pleasant.
