Visa Help
So we applied for a K1 fiancee visa which was approved and we got married in October. Since getting married we've sent everything off and had 4 letters back today. They all say that they've been received but one of them has returned the cheque for 380$ which we thought we needed to send for my employment authorization.
That ones attached to a letter saying "we are sorry to inform you that we have rejected your application for the reasons included on the I-797 Reject Notice". I don't really understand the I-797C, notice of action which says I applied for immigration benefits and that the form was "submitted with an extra remittance this is not required to process the application." Can someone shed some light on this stuff please? Hopefully it reads that we sent in forms and a cheque that we didn't need to send so they've returned it. |

I believe this explains it but I'm no expert.
If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765 http://www.uscis.gov/portal/site/usc...0045f3d6a1RCRD |

They are when the checks are not cashed because they are not the right amount or, as in this case, not necessary.

We're glad we sent separate cheques, thats certainly made it easier

Had you sent a single check you would have gotten everything back, which would have delayed the adjustment of status case. As it is, that application has been accepted for processing and will go forward without delay.
If I understand your first post correctly, your I-765 application was returned along with the unnecessary payment? If so, re-submit it along with a copy of the Receipt Notice for the I-485. Regards, JEff |
