In the US on Fiance Visa: Lost Birth Certificate and NOA

My fiance (American) and I (Indian) are planning on getting married this week. I came
to the US last month on a Fiance Visa. I was looking at the forms we would have to
submit to the INS after we're married and I realized I have some documents missing-:
1)My Birth Certificate This was submitted to the US Embassy in New Delhi for my VISA
and returned to me in the Sealed Brown Envelope. The contents of the envelope were
taken over by the INS at NY, my port of embarkation.
2)My fiance's Notice of Action/ Approval She got rid of these papers after I reached
the US assuming we had no further need of them.
My questions are: are we going to have a problem because we don't have these
documents? What can we do?
Would appreciate help from someone who's experienced a similar problem.

You will need to have the NOA to file. You'll have to get and pay for a copy:

The birth certificate should be OK if it really is in the brown envelope. You might
want to go into the local INS office to see if you can at least file without the NOA
so you can file within the 90 day period.

Hi Andy,
Will this apply to me? My fiancée had to FedEx the original NOA to London because the
petition got lost somewhere between CSC and London. It went into the brown envelope
and there it stayed!

Andy thanks for your very helpful reply! I've downloaded a copy of the form I-824.
How long will it take for the INS to respond to this form and send us a copy of the
NOA? Also is there any way I can check with the INS (before I file the AOS forms) if
they have a copy of my birth certificate?

It usually takes a while for them to process it. That's why I suggested seeing if you
could file without it. You could also ask for them to open the brown envelope at that
time to see if the birth certificate is in there.
