Hi ,

I am right now on GC and going to become citizen sometimes in Dec I hda married with
my spouse who had come on tourist visa and then overstayed. So once I become citizen
can I file for her greenceard. Does she need to leave the country to get her GC. Any

In addition to Sylvia's excellent response, DO NOT allow her to leave the US until her
Green Card is approved. She would most likely be banned for three or ten years (depends on
how long she overstayed).
