Hi, this is my first post here.

I'm a UK citizen and my boyfriend is a US citizen. We're planning on applying for a K1 visa so I can go and live with him in the USA.

However, he is a student and works part time, and is supported by his parents for the rest of his living expenses. I have savings to support myself during the first few months before I get a work permit so money isn't an issue for me, and I'm looking forward to him getting a great job when he's qualified...

Anyway, my question is: will his parents need to co-sponsor the application so that he can prove his income is enough to support me?

Unless you have sufficient assets ($52,500 I believe) if there's just the two of you, yes I believe that he would need a joint sponsor.

For the AOS, yes, it sounds like his parent(s) will need to be joint sponsor. Go to www.uscis.gov, Immigration Forms, I-864 and I-864P to see the Affidavit of Support and the Poverty Guidelines.

For the K-1 visa, it's the I-134 Affidavit of Support which is required. If you have enough in savings of your own, you might qualify for self-sponsoring. If you don't, then he will need to do an I-134 and also use his parent(s) as joint sponsor for that as well.

I hope you just posted shorthand and understand the visa because that's not what a K-1 is for. It allows you to get married within 90 days of arriving and adjust your status without having to leave the country. You can't just get one, use it and then live in the US.

Oh yes, I've looked into it in detail, thanks for your concern though. We intend to do the whole marriage thing.

If your boyfriend's income is insufficient, yes - you can ask his parents to be *your* (not the application's) joint-sponsor (not co-sponsor) so that *they* (not he) can prove *their* (not his) income is sufficient to support you. Sorry for being pedantic, but when dealing with immigration, terminology is everything and words have exact meanings.

By the way, any US citizen or PR, over age 18, and living in the US can be a joint-sponsor. It doesn't have to be his parents.
