They just have to show that they have enough money coming in regularly to
pay you, or that they have enough money in the bank.

In general, BCIS wants to see the last two years tax returns. If the
company is too new and hasn't filed two tax returns yet, instead provide
contracts, bank statements and the like. And hire an attorney to guide
you! There is too much at stake to skimp here.

Hello Ingo Pakleppa & Others:

Hope you all might have gone through my previous messages..

Recently INS asked 1st RFE they asked for my employment letter/paystub. Which I produced nothing more than that. But since I changed the employer from the one who originally filled they have I believe asked for 2nd RFE in which they asked for
"Ability to pay me the salary from the my current employer +
hence in other words to provide evidece that that my employer is able to pay me the salary. Hence INS has requested the current employer to show the annual reports or federal tax returns or audited financial statement etc like that, untill benefiaciay gets the lawfull permanent residence like that. "

Also form DE-6 quartely wage report.

But by the time I am showing the evidence for 2nd RFE, I change my employer. Hence what I am now doing is sending the INS the response of the 2nd RFE along with my recent paystub, employment verification and offer letter of my new employer. This new employer is showing all the documents which ins is willing to see.

Hope I am able to say my situation clear.

So what is the next thing ins is suppose to do after getting the documents.


Plz advice me.

The original employer already provided similar documentation, the new one
simply needs to prove the same thing over.

Yes, that should be fine. Of course, changing employers twice during the
I-485 phase may confuse CIS (INS no longer exists; CIS took over these
responsibilities) a bit, but it shouldn't cause any serious problems.

So the USCIS is asking for letter/paystub for RFE?
In this case there's a chance for denial for me since I could not find
something similar job/salary.

Don't panic. CIS may end up not caring - you never know. As the saying
goes, it ain't over til it's over. Of course, the more different the job
is, the more risky it gets, but in the end it's a discretionary decision,
no matter what.

Thanks Ingo.
Since the company started processing my GC 2 yrs ago I've never
stopped reasearching/reading about immigration subject. I see all
kinds of answers coming out and most of them are contradictory to each
other even lawyers.
Sometime you don't know whom to believe.

In this particular topic one of your answers in other topic CIS might
check in the DOL about your job change (it's posted on your website).

And now you're saying CIS may end up not caring. I still believe you
since you're using the word "may".

All I'm saying is CIS is really UNPREDICTABLE.

I'm glad you were astute enough to pick up on the word "may". Indeed I
chose it deliberately. I don't recall the specific response that you refer
to, but what you quoted is indeed consistent with what I usually say.

Your context is slightly different from most, though. Most people, I tend
to warn not to stray too far from their field *before* they choose to
change jobs.

In your case, that has already happened and is water under a bridge, as
the saying goes. You can't really undo that (well, actually, you might
improve your situation if you found a new job back in your old field, but
it still wouldn't be quite the same). So for you the issue is to deal with
the fallout. And the fallout is simply an increased risk. At this point,
there really is nothing you could do but sit back and wait and see what
happens. It is entirely possible that either a CIS officer notices and
decides that it's still OK (quite possible, depending on circumstances),
or that it simply slips by an overworked officer.

Fortunately, for you, the CIS unpredictability would likely work in your
favor.

Hello Ingo Pakleppa, Sylvia Ottemoelle, Manish & Others:

I submitted the 2nd RFE documents few backs to the CIS.
Now when I check the status online it says that..

My case of AOS / I-485 is being transferred to SFO CIS (San Francisco BCIS office). They will schedule any interview and intimate me the same. I hv't got intimatation for interview though it, I would like to know the following..

Why is my case being transferred to SFO CIS? Because I have couple of friends for whom the tranfer of case d't happen and they got approved directly.
Is transferring the case to local CIS i.e. (San Francisco BCIS office)
is something good or bad or normal something happens if so on what circumstances?
Is it possible SFO CIS Can directly make the decision on my case without scheduling interview?
How long typically takes them to schedule for interview?
Is that will I be asked anything on my employment history so far?
What is the purpose of interview ?
What i am suppose to prepare or I will be expected to ask?
What happens normally after the interview?
Any docs I need to take.

It is a fairly normal thing. CIS has a long-standing policy of
interviewing about five percent of all I-485 applicants. While some are
picked for something that needs clarification, many are picked at random.

It has also happened that CIS sent files to the local offices if CIS was
overloaded and the local offices weren't.

If it was transferred for the interview, no. Otherwise, probably yes.

I really don't know.

Possibly. They will probably go over the answers you gave in the I-485.

Technically, the interview is intended to give a human a chance to assess
you personally, and see if there may be any discrepancies between the
application and your actual situation.

You should be ready to answer questions related to anything you said in
the I-485, as well as about your current employer.

I-485 approval. Not necessarily the same day or even week, though.

Recent pay stubs and other evidence that you are still working there. Or
if you took advantage of AC-21, evidence of the nature of your new job.

Also, put yourself into the interviewer's shoes: a person he has never met
makes certain statements on a form I-485. His job is to figure out whether
or not your statements are believable.

Thanks for your tip, answers and suggestions.

Today we received letter from the CIS Transfer Notices for my case to local office CIS indicating that "preliminary processing of the...application...has been completed" and it has been transferred to the San Francisco CIS Office. The SFCIS will notify us when they schedule an interview date for you both.


My question is in what sense I can consider or take that "preliminary processing .. is done" in my favour. Like from that what can I understand how can it speed up my case.

*for you both*? I had assumed that you had applied for employment-based
AOS. If this was marriage-based, there would always be an interview (but
then, the case should have been filed with SFCIS in the first place and
wouldn't have been transferred there).

Preliminary processing means that pretty much everything has been done
(fingerprints, background checks etc), and all that's left is the
interview, and possibly a few minor lose ends to tie up.

Yes we did applied on employment-based EB3 for me & my wife.

Today I got an an schedule interview with SF-CIS in which they asked to bring along with I-134 form dully filled. I was looking to the form and got some querries on some of the questions which are mentioned below.

1. I have a deposite in the savies bank $..........
2. I have a person property which is worth of $............

My querries are...

1. Why is I-134 required i guess i should show to the that i can support for my wife if that is true okay, if its any reason apart from that? Possible other reason.

2. What is the dollar value for above 2 collums would think i can support my spose say adding both of them if its say for eg. to $ 35,000 (will that be okay)..

3. Does any body has this kind of form to be filled during AOS of final stage and the interview.

Any reponse to this will be appreciated...

Office policy. I think some offices require it, some don't.

That should be fine. I'm not sure about the 100% correct value, but as
long as you make enough money to support both of you (at least around
$15000 per year), you would be fine. For EB cases, this is implicitly
almost always the case.

Do bring some pay stubs to show your income.

Thanks for your response and tips.

I was going through, interview notices. They have asked me to bring the copies and originals of some documents, to mention a few are....

1. Passport of mine and spouse :

So do i need to take full pages of the photo copy or just the visa stamping in the passport. Is that also in color or b/w copier.

2. They have asked to bring the all legal AP documents i.e. advance parol. Well when I applied initially for the final stage of 485, I and my spouse got an AP which got expired on oct 2002.
I d't applying for renewal since that time there was no plan for overseas travel. But lately I only applied for AP just for emergency and I have a valid AP till untill jan of 2004. My wife d't hv any valid AP. Is that something okay if my wife d't have any valid AP. Simply because we d't renew her AP. Kindly advice me on the same.

I am also taking all prior h1b approvals and h4 approvals to show my legal continuity of status.

3. They have asked for I-94. I have a quistion on this. When I
re-entered last time I had a valid I-94 untill oct 2002. My I-94 was with respect to the company X's visa. Then I switched the company from X to Y. The company Y applied for my h1b and my spouse h4. After I got h1b and h4 approval, I sent for revalidation for both mine and my wife some time in jan 2003 and we got it back stampped successfully in apr of 2003.
After I got my PP, in couple of days I got laid-off from the company Y.

Mean time after we got visa revalidated, my wife went to india (may 2003) on an emergency basis and came in june of 2003. She went with h4 which she got revalidated and stamped from my previous employer 'Y'. Because I d't apply for her AP renewal,
I thought she can re-enter us with H4 itself as It was emergency also. I also notified my previous employer 'Y' i.e. not to cancel my h1b visa or d't notify INS untill I land in a job like give me couple of months time like that. So my wife came re-entered without any problem with my last employer 'Y' H4. She is having a I-94 untill jan of 2005.

Then I got a job offer from a company 'Z' and presently working with them in my EAD.

My questions US-CIS also wnats to have I-94 during the time of interview, which my wife has from my my previous employer h4, (she re-entered that too when I was laid of from previous employer 'Y') is she subjected to have any impact on her legal immigrant status OR its nothing to be worried on.

Kindly advice me on the same.

In this case, bringing the originals is more important. But do bring a
copy of all pages of the passport, even the completely blank ones and the
front and back cover.

No problem. There is no requirement to have A/P; they merely want to see
those A/Ps you did apply for.

Good idea.

The fact that it was an emergency is immaterial. It is also immaterial
whether or not you changed employers in the meantime, since the visa stamp
is not tied to the employer at all. What does matter is whether or not you
were in H-1B status at the time - that is, if company Y had sponsored you
for an H-1B transfer and had not laid you off yet.

If, at the time your wife returned, you were between jobs, then you could
potentially have a problem, although my guess is that CIS would view it as
a technical violation and forgive it.
