Update on processing times
 
I just got off the phone with a USCIS rep, and she told me that the backlog is such that they now need 90 days to acknowledge receipt of documents. In my case, I sent in my I-129F for a K-1 Visa on August 31, and my check has not been cashed yet. She further stated that a check is not normally cashed until the case is set up. I was hoping that the flood of applications would have stopped just after July 31, and that USCIS would have been able to catch up with the backlog by now. :curse:

She further stated that a check is not normally cashed until the case is set up.
Bzzz... that's clearly a lie! Checks go to the Treasury Dept for deposit... it has nothing to do with your case.

I don't think that they cash the check until they have decided that they will accept the application (that is, it is complete). I have read in other places here that if they reject the application because it is on an old form, the ink is the wrong color, you used the wrong postage stamp (I made the last one up, but you never know!) then they send the whole lot back.
Just an observation - could easily be wrong.

Possibly... but if applications were complete before cashing the check, people wouldn't receive RFEs due to missing info! :)



... you used the wrong postage stamp (I made the last one up, but you never know!)

Using out-of-date forms and using wrong forms might be "fatal flaws" that would be cause for rejection and therefore not cashing the check. RFEs do not fall in that category, and imply acceptance of the application, so the check would be expected to be cashed in those circumstances.

We sent in I-130 on Aug 9th. I did it on wrong old form. Received it back by 13th August. Resubmitted on the correct form with correct fee and they acknowleged receipt on the 15th August., payment taken by Credit card on 16th.

There obviously is a backlog but they are definately not swamped

Since you are filing directly through the Embassy, the backlog discussion doesn't affect you. The Embassy also handles rejections etc differently than the Service Centers in the US.
