Hi, Hello and Howdy,

Not really sure of how this whole forum thing works, but will be exploring it until I start to understand. While I'm heading off to do the whole wiki thing and all the general things newbies need to I thought I'd try to get the answer to a question or two this way.

I'm engaged to a US cit and we intend to get married as soon as funds allow, question is, is there a limit to the times you can use a 90 day travel visa in a year? (and) Can you continue to travel back and forth between the UK and US on 90 travel visa's while in the process of applying for fiancee visa?

I'm not really up to speed with the jargon yet but hope to get my head around it all soon.

Hi and welcome to BE

I take it by the '90 day travel visa' you mean the Visa Waiver Prorgamme (VWP) (which isn't a visa at all!! )

No, there aren't any limits as such although best practice dictates that you spend more time out of the US in a 12 month period than in. Taking evidence of ties to the UK and having a return ticket is a good idea also.

You can travel under the VWP whilst your visa application / petition is being processed.

The general consensus is you need to be out as much as you are in, i.e. if you stay the full 90 days you should remain out for that long before your next attempt.

More frequently than that and the border agents get suspicious....especially if your stays are long interspersed with short periods out of the country. If you do that they cotton on that in reality you are living in the USA, which is not allowed without the correct visa.

The fact that you are engaged to a USC only serves to raise suspicions that you will attempt to stay and adjust status (based on getting married to a USC), which may be considered immigration fraud.

As YWFWT pointed out a Visa Waiver is the exact opposite of a visa.

Go read the wiki and then ask more specific questions.

Whatever happens, the overwhelming probability is you'll need to marry the girl to obtain the correct visa to live and work in the USA.

Or have the intent to marry your USC fiancee and get the K1 fiancee visa.

And don't forget that she can come visit you in the UK for 6 months if she's eligible and able to travel for so long.

Yes, there is a limit, but it is an unwritten rule and depends on your overall circumstances.

You can not live in the US while waiting for the K-1 visa.

The entire K-1 process from start to visa is about 6-8 months.
A lot of the foreign fiances find this is a good time to live tight and save up money for their move (there is a period of time after arrival where you won't be eligible to work).
