Is it illegal to enter the US to visit while an approved I-130 is pending at the NVC.
If I went to the airport to take a flight to come to the US, will my name pop up on
the computer showing that Im in the immigrant process. I have heard conflicting
stories of people coming to the US to visit their spouse. Some say they have no
problems and some say your name will come up and then you'll be banned for trying to
illegally enter and the pending case will be rejected, some say its totally legal and
up to the officer at the POE to determine it is just a visit and you plan to return.
I even got conflicting feedback from the INS 800#. Some say you can and some say you
cant. Any info would be appreciated. Oh, by the way, I would be flying from Canada.
Thank you in advance

It's not illegal. You might be denied entry if they think you might be planning on
staying in the US

Thank you for responding. Anybody out there want to share their personal experiences?

I was wondering about something similar. Can someone with a pending K1 visit from
Canda to the US? I've heard it's not permitted.
I know that if you have an I-130 pending and are in the US, it's not illegal to
return to Canada for a visit but you must receive permission from INS.
