Default travel to mexico with expired visa and in a new status

Hello Gurus,

Could you tell me if I read the regulations on Automatic visa
revalidation correctly?

I'm going to travel in Mexico for about two weeks with my wife. We have
expired US visas (J1 and J2), and my status changed from J1 to H1,
while my wife changed hers from J2 to F1. We are not going to apply
for new US visas. Do I understand it correctly that we will be able to
enter the US with our expired visas, even though our status changed?

Thanks a lot for help

Andy

Check 22 CFR 41.112. It depends how long you are staying in Mexico, and what country issued your passport.

In most cases, this is indeed true. There are a few nationalities that
are excluded from automatic visa revalidation, and it also does not
apply if you are applying for a US visa at a consulate in Mexico.

Of course, all the standard grounds for inadmissibility still apply. In
practice, you will probably just be waved through, but if you, say,
committed a crime or acquired HIV, you would still be inadmissible.

Thanks a lot to all who sent a reply. One more question, which didn't
come to me earlier. It doesn't make difference if I cross the border by
car or fly, does it? It seems to me that last time I used automatic
revalidation (which was in 1997) it could be used only at car crossing
checkpoints, but now I see no reference to that.

Automatic revalidation is good no matter how you travel, although I have
heard of cases where the airline inappropriately collected the I-94. You
should watch out for that when boarding.
