time limit on I-765?
 
Hello,

My wife submitted an I-765 last July. We also applied for AOS at that time.
We had our AOS interview in Jan 03 and are still waiting a decision.
so it's been over a year since we last filed I-765 (she hasn't worked yet)..
does this expire? Do we need to spend another $120 for another year?

You've been waiting a *year* to hear back on your EAD application? Did you ever get a Notice of Action? Did you send the I-765 by registered mail, or do you have any way of knowing that they actually received it at your BCIS office/Service Center?

We got the work approval immediately. I was speaking about the fact that we
are waiting for AOS approval.. in the meantime the work approval expired
(her work permit card states an expiration of 7/22/2003)..
so now do I have to re-apply with another I-765 and another $120, even
though we are awaiting INS approval of her AOS?

Hi Jeff,

Oh, from reading your first post, it wasn't clear that she actually got her first 1-year EAD. I think the renewal procedures allow you to apply for a renewal EAD up to 3 months before the expiry date of the first EAD. However, I'm not sure whether the I-765 is the correct form to use to apply for a renewal EAD. I would download the application form from the BCIS website to check the instructions - I would be inclined to think that there is provision to use the same form, but I don't know if it would continue to be under category (c)(9).

Whatever happens, she will not now be able to work without a valid EAD. I don't know if the renewal fee is also $120.

as i understand it, you should have renewed it prior to it expiring. now that it has expired you have to wait for the aos to come thru to obtain another one. id call the immigration 800 number to see what they say.
