Default Tax Returns for N-400

Hi Folks,

N-400 submitted on Monday. It requires 3x years of tax returns. However, my husband's 3 years is met in Feb 2020. We had 2017 & 2018 tax returns, but not 2019 (obviously).

Because we have not prepared/filed our 2019 tax returns yet (e.g. the third year), will this cause any problems with my husband's current application?

Is your husband basing his eligibility for US Citizenship on marriage to a US Citizen [you]? He does know that the marriage has to have passed its third wedding anniversary before filing as well as having had his permanent residency for 3 years, right?

If the above two criteria are not met, then he is not eligible to apply for naturalization.

That being the case, you, the spouse, should have filed at least 3 years of tax returns while you were married and have claimed him as your spouse. It doesn't matter if he worked or not or if he were still overseas when you had to file, he should have been claimed on your income tax return.

I'm not going to hunt back to see how he obtained his permanent residency, i.e. through US Consulate or here in the US through USCIS.
