Greetings BE's. I am currently in the states and getting married next month to my USC fiancee. I'm a British citizen and here on an ESTA.

We are yet to apply for the marriage certificate as I have a question regarding that, but also a couple more so bare with me.

Q1: do I or my fiancee apply for the marriage certificate? We're getting married in Ohio, I understand that the USC must apply in the county in which you live. But is it any different marrying a foreiger?

Q2: once were married and I return home (planning for the CR-1 visa) how will my wife's taxes change? She is still living at home with parents and is studying at college.

Q3: having already worked in the states on a J1 visa, I have a social security card already. Will this be helpful when it comes to taxes?

I guess we're a little stressed about the whole tax changes and all and need some guidance or advice from people that have done this already or similar situations.

1. Yes, you both apply. It's no diffrent with a foreigner.
2. After marriage, she must file the tax return in the "married" category. Probably easiest to file "Married Filing Separately". Any other tax questions should be posted in our main USA forum.
3. Yes.

Tax may get complicated if her parents still claim her as a dependant. If they use a CPA I would consult with them.

Long term you should probably be married filing jointly.

Thanks for your responses guys. Yesterday we got our marriage license and are planning to marry on Saturday.

Her parents no longer claim her as a dependent.
