Hi,
I am an AOS pending, EAD expired on early February,
Sent my 765 renewal early December, and the check got
cashed end of December and I don't have a receipt from
the INS.
I was not allowed to get in at 62 days in the INS, and was
told that "maybe" with a letter from employer I'd get an
interim, but I did not go that route based on some third
party advice.
in 2 weeks, my 90 days are up, I was wondering what I
should be doing, going there at 90 days ?, 90 business
days ?, or just wait until I do get the EAD letter to go and
show up to get the renewal card.
I don't have any issues with my employer, though at this
stage this is a personal preference, and I really do like
to square this away.
I really do have to work, my USC wife is in school, and
I am the co-sponsor, w/o me working, she is out of
school, and we can't pay the mortgage for the house,
I have been here for the past 12 years from F1, H1
then AOS... and I think it is silly that after this long
it has come to this, where I am being harassed just
because I sent an application 60 days before and not
90 days![Smile](https://britishexpats.com/forum/images/smilies/smile.gif)

You might fine something in this link that might help if your employer asks for a new EAD.

Go at 90 days. The purpose of the letter would have been to get the EAD
processed on an expedited basis (ahead of everyone else who filed at the
same time as you). After 90 days, you can get an interim EAD, and you don't
need to show a basis for expedited processing.

This is a lesson to everyone -- be sure to file your I-765 more than 90 days
before the expiration date of your previously approved EAD, or any other
work authorization or status which is about to expire.

Thanks for the responses, thought it seems that the 90 days
varies from INS office to office, and in the main INS site;
as I had posted before, it states it should be 6 months.
I'll try at the 90 days, I'll post my result in here, whatever
that happens.

Could you give the citation for the page on the INS site that states that a
person is eligible for an interim EAD after 6 months?

I am sorry if my post was misleading, I meant to say that,
according to INS you're supposed to send the application
6 months before the EAD is expired. 90 days still apply
to the Interim EAD.

Don't go on the 90th day but the 91st day. Others have been turned away when going on the 90th day. You know the song, don't you "What a difference a day makes. 24 little hours."
