Default Step Son wants to come live with us

Hi All,

I have not been on here since my husband and I got married in 2003. This was the greatest source of info for us in the process of getting his fiance visa. Thank you very much

At the time we applied for my husbands k1 we also included his two sons in all the paperwork in the hope that they would be coming too. That didn't come to be, however now my 18 year old step son has asked to come and live us. Does anyone know what the process is to get him here. Is it going to be easier since we included him in all the paperwork from the beginning.

Any help would be greatly appreciated...Thanks very much, Jill

Hi and it is good to see you again.

As your UK husband become a USC yet? If so, he can file the I-130 for him and if not, you can apply for your stepson's immediate relative visa by filing the I-130 stateside for him. Once approved and you have sent in the I-864 Affidavit of Support to the NVC and it is approved it will be forwarded to the US Consulate in London. From there he needs everything that your husband needed for his K-1.

The timeline will be about 6 to 8 months.

Yes, the paper trail does help. It doesn't make it quicker but by having it, the process won't be prolonged.

Rete,

Thanks, that was a quick response.

My husband is just now applying for citizenship. So I will apply for my stepson at the same time. Thanks so much....I will be back I am sure.

Keep up the good work, it has helped so many people.

Great. The fact that you were married before he turned 18 is what holds your ability to petition for him together.

Please come back and use the resources in the wiki and ask questions. Someone is always about to help you stay the course.
