Default STARTING PROCESS

We are ready to start the K1 fiance visa process and have no clue what
we are doing. My fiance lives in Kentucky and I live in London
England, so we have worked out that the centre to which application is
made is the Texas Service Centre if we are correct? I have read that
a faster service is available through some Centres - think its called
expediated service. Does anyone know if this is available to us
through the Texas Centre/London England?

Does anyone have any idea how long applications are taking from start
to finish?

Any feedback much appreciated

Where does your fiance live at in KY? I'm a KY native and my hubby is from Scotland. We just completed the K1 this year and are now in the process of Adjusting his status.

Where you send the I-129f all depends on where your fiance lives. You have no choice but to send the I-129f to the Texas Serv Center. Last year, it took us 6 months to get the I-129f approved, but I believe that they have sped up immensely. If you want to check the current processing dates, take a look at www.uscis.gov and click on Processing dates on the right hand side of the page.

But, once the I-129f is approved, it will still have to be sent to the National Visa Center. The NVC does some kind of processing to it, then forwards it to the London Embassy. That step of the process could take about a month or so (it just depends on how busy the center is). Once London gets the approved petition, they are usually pretty quick in sending you the package of documents (called Packet 3) you need to fill out and return back to them. Currently, I think London is giving interviews about 4 weeks after returning Packet 3.

There is no sure fire way of knowing how long the whole process will take. It depends upon how busy the Serv Center, if you've sent in all the correct info with the I-129f (if you didn't, you'll receive a Request for Further Evidence), if you get a hit on your name in the IBIS database it could take longer to clear your name, if you've had overstays or criminal convictions that could also complicate matters. For us, which was with no overstays, convictions, no IBIS hit, and no Request for more evidence, it took 9 months for my husband to get the K1 visa.

Hi, The whole process has taken about 7 months for us...my fiance is in Florida, and Im in England, so we had to file the 129f in Texas. I got my London interview date this week for middle of August, and we first filed last January....but I have also heard that approvals are taking a lot less time now....good luck...it can be a nerve wracking process...but well worth it to be with the love of my life forever...

Everyone is really helpful here. Its nice that people care about one
another through this whole process.

Someone said if we have no choice but use the Texas Service Centre -
can we use a different perhaps faster one? I did look at a site which
said that Kentucky would come under the Texas SC. We just want this
to come to conculsion quickly. I've been looking at other posts in
this group and dont think that the London Embassy do direct consular
filing which it seems would quicken the whole thing. Am I right on
this? We've decided to fill in the forms together when he comes over
her to London next month then when he returns to Kentucky he will
overnight the forms to the service centre. I looked at timelines and
it seems its taking 3 months from Texas. Is there anything I can
start doing over here in London yet or is it too early to start things
like police checks?

To you who are almost there we both are so happy for you.

Our process thru Vermont and London was from filing date to AOS interview date is 516 days but........ at least most of those days we were on the same side of the pond

If he's in Kentucky, you're stuck with the TSC - I'm afraid there's no way around it.

London does do DCF, but not for those who do not have LTR.

It's never too early to start. Police checks generally take the longest time to get so it's a good place to start. You should also start to gather the various forms you'll need - long form birth certificate, divorce decrees (if necessary)... stuff like that.

DCF or the unofficial term of Direct Consular Filing is only open to those couples who are married and living in the UK.
The fastest service center for K1s is Vermont which means your prince would have to move to a state covered by that center. That's usually not an option for someone unless their job is transferable, since he has to show proof that he can support you on another one of those interminable forms, .
Aside from getting the police report (which can take 40 days +/-) you want to check and get a vaccination record. The Embassy website has much good info as well.

Leave to Remain - it shows he's resident in the UK and not just a visitor.

I was in the US over 2 years ago and went on the VWP. Unfortunately I
ended up overstaying by 6 weeks. Is this going to cause any problems
for us when we file for the K1??

I'm really not an expert, but from what I've read on here through the various months, is that it's people who have overstays of longer than 6 months that seem to have the most problems.

This could be an issue, but then again it might not. I think it'll all be up to the Adjudicator that works on your case in London (once the I-129f is approved at Texas SC). If it does become a problem, then I believe you are then required to file a hardship waiver (I can't remember the form number right now) to try to get approved for the K1.
