I am a little confused about how to get my SSN without EAD. I filled my Adjust of Staus marriage based with Texas Office. Can I have my SSN wothout EAD?

Yes, you can apply for your SSN before you apply for EAD or AOS. See my timeline below, just for an example. Good luck

Depends on your status. K-1 or K-3? K-1 you can as long as SSA can
verify your status before your 76th day after entry and it's in your maiden
name (assuming you are a woman). K-3 you need the EAD from day one after
entry to be assigned an SSN.


You need Form SS-5 to apply for an SSN:

Take that to your local SSA office:

http://s3abaca.ssa.gov/pro/fol/fol-home.html

With proof of age, identity and work authorized status. Birth
certificate (if available), passport, I-94 with K-1 or EAD card.

I am in process of adjust of status, my visa was B1. I called SS Office and they told me that i need a document from INS telling that i am an lawfully admited in USA. i am getting lost with that because i am not going to work now but i would like to have any document with me because i am needing to have healthy treatment. My question is: Can I get a SSN without EAD? I am not K1/k2 visa, i am married with an american citizen for almost 7 months and waiting my green card be issued.

Hi All,

Without an EAD or I-551 about all you might be able to get is a nonwork
authorized SSN. You need a valid nonwork reason and documentation for
needing an SSN and about the only valid reason you might be about to come
up with is if your state requires an SSN to issue you a driver's license.

You might also apply for an ITIN from the IRS. In many instances this can be used in place of a social security number as reported by some who have done this when they were ineligible for a social security number.

ITIN is an individual tax-payer identification number. It can
sometimes be used in place of a social security number.

When my wife and I went to the SSA office, we asked the clerk if we
should file with her maiden name, or her married name. The guy rudely
replied, "Well of course her married name. That's her name isn't it?"

I hate that office. Anyway, we did as he said, and she now has an ssn
with her married name on it. There were no problems. She does have
ED by the way.

But she had EAD when apllied for a SSN? Why some people can apply for a SSN before EAD and other don`t?

Hi All,

OK, lets assume we are talking about a K-1. An individual with current K-1
status can be assigned a work authorized SSN without an EAD. However, SSA
will not assigned an SSN or issue a card when an individual's status is
within 14 days of expiring. The K-1 status is good for 90 days, but after
76 days a K-1 will need an EAD.

Once a woman with a that K-1 gets married and wants an SSN card in her
married name, she will need an EAD in her married name. The reason for this
is that when the SSA office checks SAVE, it will say Ms. X with K-1 status
can work, but Mrs. Y is now asking for a work authorized SSN, so they send
the G-845 to check Mrs. Y work authorized status. BCIS has never authorized
Mrs. Y to work.

Now I'm sure somewhere in some office an SSN has been assigned or
replacement card has be issued to a woman without an EAD in her married name
based on her K-1 status and her marriage certificate and you have nothing to
lose by trying it.
