Default simply question??

I am reading and reading about K1/K3 visas...getting confused by the minute.
My fiance lives in Pittsburgh and I am a Canadian Citizen. We love each
other dearly, and want to be together. So, we are looking into the options
available, is it possible that I can just moved down there and live with him
and not have to marry him. (Nothing wrong with marriage, but both of us have
been through that before) I would also want to work there too. Can anyone
help on this. thanks Leeanne

My German wife and I talked about your delima with marriage as well, before we got married.. What we wanted and what was decided was two different things. 1st we justed wished we lived in the same country, so we could just live together, since we both had previous marriages. Since she is in Germany and I am the US citizen, that couldnt be an option for us. So we married so we could go the K-3 route. Its all about love! If not she would have no reason to come to the US, since Germany is not a 3rd world country. They do have a good way of life there too! I am even considering moving there maybe after retirement? Its an option as well.. Good luck in what you decide to do!

Hi Leeanne...
I'm Canadian too, and my fiance is the USC. We were looking into everything too, and just wanted to be together. What I would recommend, if you can afford it, is to go down to visit him for an extended period of time & get to know him. Being Canadian, you have a maximum of 6 months that you can be in the States for at one time. Unfortunately, we couldn't do that, since financially it wasn't an option for me - the longest I could take off work was 3 blissful weeks. But if you have the savings, I highly recommend this option...that way you'll have more of an idea if you want to go the K1 or K3 route, if you're unsure.

Good Luck, you've definitely come to the right place for questions & answers!

Leeanne,

If you are just looking to immigrate to the US, not to get married, you should stop looking at marriage-based visas like the K visas. You will want to find another way to do it.

Yeah..
K1 = must get married 3 months after entering the US with the visa
K3 = already married

If you really don't want to get married, I would also suggest looking at
other types of visas, and probably a longer wait to be together. I'd suggest
(as others did) spending more time together in person and deciding what you
really want - and strongly considering getting married at some point if you
really do love each other. After all, you did say he's your fiance, correct?
Also, with the K1 it would probably be about a year from when you apply
before you'd have to get married with how slow the service centres are on
average.

Hi:

No problem at all if you otherwise qualify for residence in the United States. Wrong NG for answers on that question.

You can live together without getting married and you can do it legally and non job based. You just have to do it Canada and not the US. In that respect you are luckier than most.

Leeanne,

You can't just move to the US and live because you're not a US citizen. There are laws that restrict immigration - Canada has such laws also. All nations do.

And you don't have to marry someone to immigrate. But you do have to have a reason to immigrate that allows you to do so. It just so happens that marriage to a US citizen is one such reason.

If you don't want to immigrate to the US on the basis of marriage find another reason that will allow you to immigrate. Or find a reason that will allow your boyfriend to emigrate to Canada. Or the both of you find some third country that will allow you to immigrate there.

It would be nice if every country would allow anyone who wants to immigrate, for whatever reason. At least some people think so. Unfortunately, there are few, if any, such countries. Certainly neither the USA nor Canada are.

Regards, JEff

Canada does accept co-habitation and same sex relationships for immigration purposes.

if it's just a piece of paper, my thoughts would be to do the marriage route and satisfy them with the piece of paper - you can always get a divorce later and keep living together - just another piece of paper. (well it does cost some money too)

I know about the same sex relationships for Canadian immigration but not quite sure about the ability to migrate legally to Canada for the sole purpose co-habitation with benefit of marriage.
