Default second AOS application?? what the heck??

My wife (who came on a K1) and I applied for her AOS in 1999 in
Arizona. Her application was still pending when we moved to North
Carolina this summer. We sent letters to both Phoenix and Charlotte
requesting that her file be transferred to Charlotte.

Today we got a notice from INS Charlotte saying that we have an
appointment for "Application for Adjustment of Status" on October 15,
that we both must be present at the interview and bring the following
items:

1) appointment letter, passport, I-94

2) evidence of a common residence and shared life (see addendum)

3) medical and/or immunization supplement (see attachment)

4) photo of petitioner, 325A petitioner

A letter included said that we need to bring documentation showing
joint ownership of property, joint tenancy, commingling of financial
resources, tax returns, photos of shared events, etc.

This sounds to me like "The Final Interview," yet we just asked to
have the file transferred and expected to wait a year or more before
having the big interview.

But the letter does say that the reason for the appointment is
"Application for Adjustment of Status."

I'm very confused, and I don't know why they want us there or what to
expect. Could someone with experience PLEASE, PLEASE respond to this
and tell me what you think is going on??

Thanks,

At the risk of sounding rude, why would you think anything else? You have been given an appointment for your AOS interview. Bring everything that they requested of you. Get another medical done since your spouse's medical is three years old. Whether or not you will be approved on the spot depends on whether your wife has had her fingerprints for the FBI/CIA done recently and whether or not they have your actual file on hand.

Good Luck

BTW transferrees do not go to the back of the line.

because for the last three years these morons have screwed up every
step of our hellish journey through the K1-->permanent residency
quagmire, and i'm not used to getting good news.

what does "getting a medical" entail? the ins failed to include the
attachment they claimed was in the envelope with regard to that. does
she need specific bloodwork or anything?

My wife and I had a similar experience.
I filed for my wife's greencard in Jan 1999 in Chicago.
In July 1999 we moved to Los Angeles and had our
paperwork transferred to the LA INS office. Our INS attorney
did that for us in Chicago, that was the last thing he did for us.
We handled the rest of our case ourselves in LA Attorney-free.

In December 1999 we received (in LA) a letter from the Chicago INS
asking us to come for the fingerprint appointment. After a few phone
calls here and there, and some conflicting information, we decided to
abandon the Chicago case, and wait for the LA office to catch up
with us. I now think that was a mistake.

I'm convinced that we essentially went to the back of the queue here,
we finally received my wife's GC last week.

Regarding the medical, call the INS for an approved Doctor list.
It's essentially a very basic medical history, but they do a skin
test for TB and a blood test for HIV.

good luck -
Dave

I understand how you feel. My paperworks also sit in hibernation
and didn't expect to hear anything from INS for two years, until
two months after sending change of address form, suddenly
we were invited for the final interview. Dunno... maybe if you
change address, they'll notice you
